COUNCIL ACTION FORM
SUBJECT: RESOLUTION APPROVING THE FINAL PLAT FOR GRAND ASPEN
SUBDIVISION.
BACKGROUND:
The applicant, Randall Corporation, is requesting that the Final Plat for Grand Aspen
Subdivision be approved.
The property in question is located north of South 16t" Street, east of the former railroad
right-of-way and north of the Creekside Manufactured Home Park.
The proposed Final Plat involves the creation of one (1) platted lot and one (1) outlot. The
entire area of Grand Aspen Subdivision is 38.41 acres. The platted lot, which will be the
site of the Ames Christian School, is 2.07 acres in size. The remaining outlot includes
36.34 acres.
The property in question is zoned Residential High Density (RH). Both Lot 1 and the outlot
front on a South 161" Street. Access to this property is limited on the Final Plat to two
locations, because the site fronts on an arterial street.
All lots meet the requirements of the Zoning Ordinance.
The required public improvements for this subdivision are the paving of the outside lane
on south 16" street, construction of a Cy-Ride bus stop pad and the construction of a bike
path. All of these improvements are adjacent to Lot 1 of the subdivision. The developer
has requested that the City install the public improvements through the use of special
assessments. This means that the City becomes the financing mechanism for the public
improvements. A discussion of that request is found in a separate Council Action Form
and a decision on whether to grant the request for special assessments should be made
prior to making a decision on the Final Plat.
If it is decided that the request for Special Assessment should be denied, then approval
of the Final Plat should be approved contingent upon the developer signing a Public
Improvement Agreement and the filing of an acceptable form of security in the amount of
$36,000. This must be accomplished in a timely manner since a Final Plat must be
recorded within 30 days of approval, and no building permits can be issued until the Final
Plat is recorded.
The staff has reviewed this Final Plat and has determined that the plat complies with all of
the requirements of the Subdivision Regulations of the City of Ames, except for the
financial security for the public improvements. Staff is recommending t at the Final Plat
for Grand Aspen Subdivision be approved, contingent upon receiving a Pubic Improvement
Agreement and the filing of an acceptable form of security in the amount of$36,000 within
30 days.
ALTERNATIVES:
1. The City Council can approve the Final Plat for Grand Aspen Subdivision and agree
to Special Assessments for the Public Improvements in the amount of$36,000.
2. The City Council can approve the Final Plat for Grand Aspen Subdivision, provided
that a Public Improvement Agreement is submitted and financial security in an
acceptable form in the amount of$36,000 is received within 30 days.
3. The City Council can approve the Final Plat for Grand Aspen Subdivision with
modifications
4. The City Council can deny approval of the Final Plat for Grand Aspen Subdivision.
MANAGER'S RECOMMENDED ACTION:
The Final Plat for Grand Aspen Subdivision complies with all aspects of the regulations of
the City, except that a Public Improvement Agreement has not been submitted and
financial security has not been provided for the additional lane on South 16th Street, the
Cy-Ride transit stop pad and the bicycle path that are all adjacent to Lot 1. It is the
recommendation of the City Manager that the City Council adopt Alternative #2.
This will approve the Final Plat for Grand Aspen Subdivision, provided that the developer
submits a PAC Improvement Agreement for the additional lane on South 16th Street, the
Cy-Ride transit stop pad, and the bicycle path and financial security is received in the form
of a bond, a Letter of Credit, cash, or other approved form in the amount of$36,000 within
30 days of approval.
