Re: Proceedings to Vacate Drainage Easement - 6th Addition

Dear Dave:
This is in response to your letter of November 6, 2003, subject as above. The proposed Resolution
and Notice of Hearing on vacating the existing easement are approved as to form. The proposed new
easement is approved as to form. However,there will need to be a subordination of mortgage by the
mortgagees of the affected land.
Also, the Recorder will want to have your name, address and phone number, as preparer of the
instruments, to be recorded on the easement and also on the Resolution.
It is our practice to take care of filing the vacating proceedings with the Recorder,but if you want to
do that, let us know. We will place the proposing Resolution on the agenda of the next Council
meeting if the City staff is ready to proceed with this matter. Please get the revised documents to me
before close of business on November 13.
