HomeMy WebLinkAbout~Master - Agreement with UPRR for shared use path extension along 13th Street RESOLUTION NO. 18-055 RESOLUTION APPROVING AGREEMENT WITH UNION PACIFIC RAILROAD FOR SHARED USE PATH EXTENSION ALONG 13TH STREET(2017/18 ARTERIAL STREET PAVEMENT IMPROVEMENTS PROJECT) FOR THE CITY OF AMES WHEREAS, this annual program utilizes current repair and reconstruction techniques to improve arterial streets with asphalt or concrete; these pavement improvements are needed to restore structural integrity, serviceability, and rideability, and, WHEREAS, targeted streets are reaching a point of accelerated deterioration, and by improving these streets prior to excessive problems, the service life will be extended. and, WHEREAS, the location for this project is 13th Street from Ridgewood Avenue to Harding Avenue, and this project also includes the shared use path extension along 13th Street from Ridgewood Avenue to Northwestern Avenue; and, WHEREAS, the 13th Street shared use path extension requires a crossing of the Union Pacific Railroad(UPRR), and to perform this work, a crossing agreement with the UPRR is required; and, WHEREAS, a Public Highway At-Grade Crossing Agreement was prepared by the UPRR that allows the new shared use path crossing; this agreement requires the City to reimburse UPRR$5,300 for the right to construct, maintain, and repair the facilities in the new crossing area; and, WHEREAS, the new shared use path crossing will also require the City to reimburse the Union Pacific to extend the crossing panels to the south of 13th Street at an estimated cost of$11,340; and, WHEREAS, both of these costs are included within the budget for the 2017/18 Arterial Street Pavement Improvements project; and, WHEREAS,this agreement also includes construction requirements for the City,as well as a"hold harmless"and maintenance provision for the life of the agreement. NOW, THEREFORE, BE IT RESOLVED by the City Council ofthe City of Ames, Iowa, that the Public Highway At-Grade Crossing Agreement with the Union Pacific Railroad for the shared use path extension along 13th Street(2017/18 Arterial Pavement Improvements Project) is hereby approved.
