COUNCIL ACTION FORM
SUBJECT: RESOLUTION TO APPROVE THE PRELIMINARY PLAT FOR DAUNTLESS
SUBDIVISION, FIFTH ADDITION, LOCATED SOUTH OF MORTENSEN ROAD AND
WEST OF SOUTH DAKOTA AVENUE.
ACTION FORM SUMMARY: This is a request to approve the Preliminary Plat for
Dauntless Subdivision, Fifth Addition, a three lot subdivision located south of Mortensen
Road and west of South Dakota Avenue.
Approval of this request is recommended with stipulations.
BACKGROUND:
The developer is requesting approval of a Preliminary Plat for a three-lot subdivision on
40.21 acres of land, located south of Mortensen Road and west of South Dakota Avenue.
This is a replat of Outlot H of Dauntless Subdivision, Fourth Addition.
This property is currently undeveloped except for a detention pond, located on the eastern
portion of the site. The three developable lots range in size from 4.90 acres for Lot 1 to
19.90 acres for Lot 3. This site also includes Lot F, which is a 7.22 acre site that will
become right-of-way for the new access ramp at South Dakota Avenue and U.S. Highway
30. The right-of-way for Mortensen Road was previously dedicated to the public as part
of the Final Plat for Dauntless Subdivision, Fourth Addition, and that street is currently
under construction.
ANALYSIS:
Land Use Policy Plan (LUPP). The Land Use Policy Plan (LUPP) designates this site as
suitable for a Community Commercial Node. The developers have indicated that they are
planning to develop the site commercially.
Zoning. This property is zoned "CCN", Community Commercial Node, which is consistent
with the intended use of the property, and the proposed lots meet the bulk requirements
in the Zoning Ordinance for the district.
Utilities. The extension of utilities into this site will be adequate to serve the needs of this
proposed development.
Water Distribution. A 12-inch water main will be extended south into the site within
a 66-foot wide Public Utility Easement on the west side of Lot 2 for the full extent of
Lot 2. This is an oversized main, and the City will pay for the oversize. When
development takes place to the south of U.S. Highway 30, this main will be extended
south.
Sanitary Sewer. An 8-inch sanitary sewer main will also be extended south within
the public utility easement for the full extent of Lot 2.
Storm Water Management. The site will be regraded, and the existing detention
pond, which provides detention for some development to the east of South Dakota
Avenue, will be relocated and enlarged. This enlargement is necessary to detain the
storm water from Lot 1 of Dauntless Subdivision, Fourth Addition, as well as the three
lots in Dauntless Subdivision, Fifth Addition. The larger pond will provide detention
for not only the intended new development south of Mortensen Road, but also will
continue to provide detention for storm water that naturally went to the land to the
east of South Dakota Avenue. There is a storm water detention easement shown on
the plat that is located on parts of Lots 1 & 2, in addition to a 20-foot wide overland
flowage easement.
Electric. This site can be adequately served by the Municipal Electric Utility
Street and Vehicular Access. Dauntless Fifth Subdivision abuts Mortensen Road on the
north and South Dakota Avenue on the east. Mortensen Road is under construction now
as part of the Dauntless Subdivision, Fourth Addition improvements. Access to Lots 1,
2, and 3 from Mortensen Road will be limited to three locations. A joint access to Lots 1
and 2 will be located at Station 24+95.08, which is centered at the common lot line
between the two lots. No other access to Lot 1 will be permitted. Lot 2 also will have an
access via a public access easement located along the west boundary of Lot 2. A 66-foot
wide public access and utility easement is being proposed in this location in order to have
an area wide enough for the-development of a commercial, public street right-of-way, if
further subdivision of Lots 2 and/or 3 is desired later. The two access locations for Lot 3
are limited to the Public Access Easement on Lot 2 and a driveway access centered at
Station 20+65.88, which lines up with the intersection of Poe Avenue with Mortensen
Road. The two driveway accesses at the two station points shall be clearly noted on.the
Final Plat. In addition, a note to the Final Plat shall state that access to Lots 1, 2 and 3 are
limited to the three noted locations, and that no access to South Dakota Avenue shall be
permitted for Lot 1 and 2.
No parking will be permitted along Mortensen Road or South Dakota Avenue.
An eight (8) foot wide bicycle path will be installed along the south side of Mortensen Road
as part of the improvements for Dauntless Subdivision, Fourth Addition.
Cy-Ride service does not currently extend along Mortensen Road, and the closest location
for Cy-Ride service is at South Dakota Avenue and Mortensen Road.
Landscaping. No street landscaping is planned with this development.

STAFF COMMENTS:
Staff believes the Preliminary Plat for Dauntless Subdivision, Fifth Addition is consistent
with the intent and provisions of the Subdivision Ordinance, the Zoning Ordinance, and the
policies of the City, provided that the following stipulations are placed on the approval of
the Preliminary Plat:
1. That the developer's responsibility for the installation of the water main and sanitary
sewer extensions be documented in a Development Agreement that shall be signed
prior to the submittal of the Final Plat.
2. That joint access between Lots 1 and 2 shall be clearly noted on the Final Plat at
Station 24+95.08, and the access to Lot 3 at Station 20+65.88 shall also be clearly
noted on the Final Plat document. There shall be a note to the Final Plat that states
that access to Lots 1, 2, and 3 are limited to the three noted access locations on
Mortensen Road, and no access shall be permitted from South Dakota Avenue to
Lots 1 and 2.
3. That cross easement documents between Lots 1 and 2 and Lots 2 & 3, including
maintenance responsibilities shall be submitted with the Final Plat.
RECOMMENDATION OF THE PLANNING & ZONING COMMISSION:
The Planning and Zoning Commission reviewed this request at their meeting of June 7,
2000 and recommended approval of this Preliminary Plat with the following stipulations:
1. That the developer's responsibility for the installation of the water main and sanitary
sewer extensions be documented in a Development Agreement that shall be signed
prior to the submittal of the Final Plat.
2. That joint access between Lots 1 and 2 shall be clearly noted on the Final Plat at
Station 24+95.08, and the access to Lot 3 at Station 20+65.88 shall also be clearly
noted on the Final Plat document. There shall be a note to the Final Plat that states
that access to Lots 1, 2, and 3 are limited to the three noted access locations on
Mortensen Road, and no access shall be permitted from South Dakota Avenue to
Lots 1 and 2.
3. That cross easement documents between Lots 1 and 2 and Lots 2 & 3, including
maintenance responsibilities shall be submitted with the Final Plat.

ALTERNATIVES:
1. The City Council can approve the Preliminary Plat for Dauntless Subdivision, Fifth
Addition with the three stipulations noted above.
2. The City Council can deny the Preliminary Plat for Dauntless Subdivision, Fifth
Addition.
3. The City Council can modify this request and approve the Preliminary Plat for
Dauntless Subdivision, Fifth Addition.
4. Action on this request can be postponed and referred back to City staff and/or the
applicant for additional information.
RECOMMENDED ACTION:
It is the recommended that Alternative#1 be adopted. Alternative #1 is an approval of the
Preliminary Plat for Dauntless Subdivision, Fifth Addition.
