EASEMENT

Risco, L.C. of Ames, Iowa, is the owner of land described as:
H Lot 32, Fifth Addition to Country Estates Subdivision, Story County, Iowa.
Risco, L. C. hereby agrees to grant and convey, from the effective date of this
conveyance, a permanent easement of part of the above described land to the public, its heirs,
c successors, and assigns, in perpetuity, for the following uses and purposes:
A
1. The right to permanently overflow, flood and cover such real property with the
floodwater, rainwater, slack water or backwater created by Acts of God, or nature.

2. The right to enter on such real property and do such.drainage and other work as, in the
discretion of grantee, may be necessary to carry out an adequate program of pest control,
Hincluding maintenance and application of larvicides or the employment of organic pest control.

3. The right to remove or prevent the construction of any buildings or structures
restricting water located on that portion of such real property that lies on the easement area.

4. A drive and associated storm drainage(culvert) as may be needed for access.

y 5. Owners shall be held harmless by grantees for public use for grantee's failure to use
3 due care in the exercise of rights hereby granted.
6. That vegetation existing will be preserved or maintained to allow adequate storm
drainage.
