HomeMy WebLinkAboutA005 - Council Action Form dated May 23, 2000 ♦ •r ITEM # 0�7 DATE 05/23/00 COUNCIL ACTION FORM SUBJECT: RESOLUTION APPROVING THE FINAL PLAT OF ARMSTRONG'S THIRD ADDITON ACTION FORM SUMMARY: The applicants are requesting that the City Council approve the Final Plat of Armstrong's Third Addition. Staff is recommending that this Final Plat be approved. BACKGROUND: The applicant, Mary Armstrong, is requesting that the City Council approve the Final Plat for Armstrong's Third Addition. The proposed plat is a two-lot subdivision of an unplatted piece of property, which includes a house on proposed Lot 1. This property is not currently served by City water and sanitary sewer, however, water and sanitary sewer are available on the other side of South Duff Avenue. The property owner has not previously paid connection fees for sanitary sewer and water. Therefore, the City Attorney has requested that the property owner sign an agreement for a connection fee for this property. The agreement will be signed prior to Council Action on this Final Plat. If the City has not received a copy of the signed agreement prior to this item being considered by the City Council at their meeting of May 23, 2000, staff is recommending that this plat be denied. The applicant has also requested that the requirement to install sidewalks be waived, based on the fact that presently there are no sidewalks on either side of South Duff Avenue from Airport Road to the south City limits. ANALYSIS: The staff has reviewed the Final Plat for Armstrong's Third Addition and has determined that this plat complies with the requirements of the City. No new public improvements, except sidewalks, are required as part of this subdivision. Staff believes that even though there are no sidewalks along this segment of Duff Avenue, that sidewalks should be required with this subdivision to be consistent with the requirements of the regulation and the objectives of improving pedestrian mobility throughout the city. Therefore, staff would recommend that the sidewalk requirement not be waived. The property owner will be required to pay connection fees for water and sanitary sewer at a later date when connections to the water main and sanitary sewer main are requested. In all other respects, the Final Plat meets the requirements of the City. Staff is recommending that this plat be approved. (A copy of the Final Plat is attached.) ALTERNATIVES: 1. The City Council can approve the Final Plat for Armstrong's Third Addition and not waive the requirement to install sidewalks. 2. The City Council can waive the requirement to install sidewalks and approve the Final Plat for Armstrong's Third Addition. 3. The City Council can deny approval of the Final Plat for Armstrong's Third Addition. 4. The City Council can approve the Final Plat for Armstrong's Third Addition with modifications. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative #1, which is an approval of the Final Plat for Armstrong's Third Addition. City Council must understand that this recommendation for approval is based on the belief that the agreement for a connection fee for this property has been signed by the property owner prior to Council's action on this Final Plat. In the event the agreement has not been signed, the City Manager recommends that the City Council adopt Alternative #3, which would be a denial of the Final Plat for Armstrong's Third Addition.
