RESOLUTION NO. 17-648
RESOLUTION APPROVING VACATION OF ELECTRIC UTILITY EASEMENT FOR
4506 LINCOLN WAY
FOR THE CITY OF AMES,IOWA
WHEREAS, as part of the reconstruction of the Kum & Go convenience store at 4506 Lincoln
Way, the electric utility transformer and buried electric line feeding the transformer were relocated on
the site to accommodate the change in the site layout; and,
WHEREAS, the property owner made a request to vacate the existing electric utility easement;
and,
WHEREAS, pursuant to Iowa Code Section 364.7, notice was given on October 13, 2017, and
a public hearing is being held regarding the proposal of the City to vacate the easement; and,
WHEREAS, vacation of the easement is in the best interest of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
AMES, IOWA THAT:
1. Pursuant to Iowa Code Section 364.7, publication of notice regarding the proposed
vacation of the public utility easement and establishing a public hearing date regarding the proposal has
been made.
2. The public hearing regarding the disposition of the property is hereby closed.
3. The existing electric utility easement across the following described land is hereby
vacated:
A part of Lot 1, Quicktrip Subdivision, being 5.00 ft. on each side of the following
described centerline: commencing at the Northeast Corner of said Lot 1; thence South
90°00'00"West along the North line of said Lot 1, a distance of 23.50 ft. to the point of
beginning;thence South 21°10'14"West, 195.74 ft. to the point of terminus.
ADOPTED THIS 24t1i day of October, 2017.
