RESOLUTION APPROVING ENCROACHMENT PERMIT
FOR SIGN AT 3407 LINCOLN WAY
FOR THE CITY OF AMES
WHEREAS, as part of the 2015/16 West Lincoln Way Intersection Improvements,
Lincoln Way is being widened from a four-lane arterial to a five-lane cross-section with a two-
way center left-turn lane; and,
WHEREAS, the widening required the purchase of right-of-way from several properties
that front Lincoln Way between South Wilmoth Avenue west through the Franklin Avenue
intersection; and,
WHEREAS, with the additional pavement width came the requirement to relocate several
private business signs so that they were outside of the public right-of-way; and,
WHEREAS, at the Family Video and Doctors Now site, located at 3407 Lincoln Way,
the existing sign could not be moved due to the impact it would have on its site; because the sign
will remain in its current location, it will over-hang the right-of-way and require an
Encroachment Permit; and,
WHEREAS, during the land acquisition negotiations between the property owner and
the City's consultant, it was determined that the benefit-cost did not justify the expense to move
the sign and pay the owner for the lost parking; and,
WHEREAS, keeping the sign in its current location does not have a negative impact on
traffic operations or right-of-way management; and,
WHEREAS, because the City's work caused this encroachment, the $25 fee will be billed
as a cost to the project; and,
WHEREAS, the applicant is required to sign the Hold Harmless Encroachment
Agreement and provide the necessary certificate of insurance, which will be valid for the
duration of the encroachment.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,
that the Encroachment Permit for a sign at 3407 Lincoln Way is hereby approved.
