RESOLUTION APPROVING ENCROACHMENT PERMIT FOR
400 MAIN STREET
FOR THE CITY OF AMES
WHEREAS, in 2013, Randy Pyle, owner of the building at 400 Main Street came before the
Parks and Recreation with a request to encroach into Tom Evans Plaza, with a widened stairwell that
enters the basement along with other items; and,
WHEREAS, the Commission was concerned with the potential damage to the four trees
located on the west side of the plaza and the artwork mural(no longer there) that was painted on the
side of his building; and,
WHEREAS, even with these concerns, the Commission supported the encroachment request,
although Mr. Pyle decided not to pursue his request further; and,
WHEREAS, Mr. Pyle presented another encroachment permit request to the Parks and
Recreation Commission at its August 2017 meeting, and it directed staff to finalize details with Mr.
Pyle; and,
WHEREAS, the Commission approved, in concept, Mr. Pyle's request, and he is now
seeking City Council approval; and,
WHEREAS, the owner needs to bring the stairwell into Code compliance and address water
issues in the basement; and,
WHEREAS, the sidewalk along the building currently slopes toward the building in spots
which, Mr. Pyle feels, is contributing to the water issues; and,
WHEREAS, Mr. Pyle's request includes the following: 1) widen the stairwell to the east of
his building from 30 inches to 60 inches; 2) remove the concrete stairs to the Bar La Tosca entrance
and replace with new stairs; 3) cut the vertical supports to the fire escape and extend posts of the
railing below to support the fire escape; 4) remove the concrete along the building, the adjacent
sidewalk, and the north/south curved sidewalk in the Plaza, and to replace with a walkway that
extends 16 feet to the east from his building wall; 5) remove the four trees and stumps located on
the west side of the park; and, 6)repair any turf damaged during construction; and,
WHEREAS, Mr. Pyle has agreed to pay for the six items if given approval to move ahead
with this project, and he is aware that he will need to obtain any needed permits and site plan
approvals as required by the Municipal Code; and,
WHEREAS, the total area of the encroachment is 256.82 square feet, and the fee has been
calculated at$257.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,
that the Encroachment Permit for 400 Main Street to encroach into Tom Evans Plaza is hereby
approved, subject to the following conditions/commitments: a) install a new 5'x 2T V stairwell to
the basement of the building, b) remove the concrete stairs to Bar La Tosca and replace with a metal
staircase, 52"wide by 13'5.75" long; c) remove four trees and plant up to two trees with the species
and location to be determined by Parks and Recreation Department staff; d) cut vertical supports to
the fire escape and extend posts of the railing to support the fire escape; e) remove both sidewalks
through the western portion of the Plaza., and replace with a sidewalk, running north to south, which
extends 16' to the east from the building wall; fl repair any turf areas damaged during construction
or created by removing the sidewalks; g) obtain all necessary permits and site plan approvals, as
required by the Municipal Code; and, h) pay all appropriate fees associated with this project and sign
the Encroachment Permit Agreement.
