Friedrich & Sons) r 10 A G R E E M E N T THIS AGREEMENT entered into between the Park Commission of the City of Ames, Iowa, and the developers of Parkview Subdivision, namely Buck Construction Company, Inc. H & F. Builders, Inc., and R. Friedrich and Sons, Inc., hereinafter called Developers, for the purpose of establishing an understanding and a general working agreement between the two parties hereto for the acceptance, development and maintenance of a recreation area located in Parkview Subdivision (all Additions) as outlined in the attached plat. It is now, therefore, suggested by the parties hereto, for the above stated purposes, that the parties hereto shall assume the rights, duties and responsibilities as described in the following manner. That the Developers shall assume the following rights, duties and responsibilities: 1. In accordance with the plot plan submitted to the City Council of Ames, Iowa, through the Ames Planning Commission in a letter dated March 22, 1966, and approved in principle by the City Council on March 22, 1966, the Developers of the Parkview Sub- division will give the Park Commission title to approximately 12 acres of land designated as a Children's Community Playground. 2. The Developers shall furnish a survey and a deed of segments to the Park Commission free and clear of encumbrance as the area is developed and after plate are approved by the City of Ames,'.;:I the-Developers shall also furnish one abstract of title covering the entire 12 acres. 3. The Developers will grade each area prior to conveyance to rough grade with black soil on top acceptable to the Park Commission and protect the areas from damage by adjacent new construction. Contour of adjoining lots shall be leveled and graded to blend with Park land. Rough grade shall conform to City Engineer's plan for suitable and adequate surface and underground drainage. 4. The Developers will assume the cost of all the improvements as required by the platting ordinance of the City of Ames against the property for the extension of trunk services to this general area and will assume the cost of streets abutting and entrances and access corridors. 5. The Developers will provide one stub 2" T connection from water lines and storm sewer connections 6" to 12" in size if required extending to the Park Commission property line in three locations to be agreed ',upon between the two parties in order to provide water service and drainage outlet for each of the main playground areas. 6. The Developers will grant to the Park Commission free of cost all necessary ease- ments for access for sewer and utility connections, etc. That the Ames Park Commission shall assume the following rights, duties and responsibilities: I. As each of the three segments and associated corridors of the total park area are conveyed to the Ames Park Commission by the Developers, the Commission agrees to pay to the Developers a consideration at the rate of $1,000.00 per acre in lieu of the assessments normally assumed by the Park Commission in other areas of the City for utilities, services and streets. a 2. The Park Commission agrees to establish the 12 acres, comprising tracts of 1.7 acres, 3.3 acres, 3.7 acres and connecting corridors, as a children's playground area. Improvements are to include drainage as may be required, finish grading and seeding, plant materials and landscaping, suitable play and park equipment, surface roadway or walks for servicing on connecting links between playground areas and lighting to conform in character to that established in the neighborhood. 3. Ch! Commission agrees to service and maintain the area in a workmanlike manner as it would any other playground areas In the park system of Ames. To install suitable posts or markers at corner survey pins and at intervals along corridor to mark boundary lines. 4. The Park Commission declares its intent to budget and request adequate appropria- tions in its annual budget to exercise and fulfill its portion of the agreement to acquire, develop and maintain the 12 acres that have been set aside for Park purposes. 5. It is understood and agreed that the Park Commission shall furnish all labor, costs for development and for maintenance of these areas in accordance with the reasonable park planning and maintenance standards.
