RIGHT OF WAY PERMIT AND EASEMENT
THE UNDERSIGNED, Phil Coy and Sons, a partnership composed of
Jack Coy and Richard Coy; Jack Coy and Elizabeth E. Coy, husband and wife;
Richard Coy and Gretchen Coy, husband and wife; Richard K. Bliss and
Patricia L. Bliss, husband and wife; and Ames Community School District,
in consideration of the sum of One Dollar and other considerations, receipt
of which is hereby acknowledged, do grant to the City of Ames, Iowa, a
municipal corporation, its successors and assigns, the perpetual right to
construct, reconstruct, maintain and use electric lines, consisting of poles,
wires, cables, conduits, fixtures, anchors and other similar equipment,
including the right to trim or remove trees within such area where necessary
to secure a clearance of 4 feet from the wires or poles, together with the
right to extend to telephone, telegraph, electric or power companies, or a
company, the right to use separately or jointly with the City of Ames the
areas included in this easement for the purposes above enumerated, over,
upon, across or under the following described real estate, situated in the
County of Story, State of Iowa, to-wit:
The East 5 feet of Lots 1, 2, 3, 4 , 5, 6, 13, 14 and 18;
The West 5 feet of Lots 7, 8, 9, 10, 11, 12, 13 and 17;
The North 5 feet of Lots 14, 15, 16, 17 and 18;
The North 3. 75 feet of Lots 2, 5 and 10;
The South 3. 75 feet of Lots 1, 4 and 11;
A 10 foot by 25 foot easement described as beginning at a point
134 feet North of the Southwest corner of Lot 13, thence
easterly and parallel to the North line of Lot 13, 25 feet,
thence North 10 feet, thence westerly 25 ,feet, thence South
10 feet to the point of beginning;
All of said lots being located in Allenview First Addition to Ames,
Iowa, and do grant to the City of Ames, Iowa, a municipal corporation,
its successors and assigns, the perpetual right to construct, reconstruct,
maintain and use storm or sanitary sewer or both upon and underground
that real estate described as follows:
The West 25. 5 feet of Lot 19, Allenview First Addition to Ames,
Iowa.
The foregoing right is granted upon the express condition that the
City of Ames will assume responsibility for all damage to the above describe
property caused by the city's failure to use due care in the exercise of its
granted right.
