HomeMy WebLinkAbout~Master - Proposal to vacate Electric Utility Easement at 4506 Lincoln Way DO NOT WRITE IN THE SPACE ABOVE THIS LINE,RESERVED FOR RECORDER Prepared by:Ames Legal Department,515 Clark Avenue,Ames,IA 50010 Phone:515-239-5146 Return to:Ames City Clerk,P.O.Box 811,Ames,IA 50010 Phone:515-239-5105 RESOLUTION NO. 17-604 RESOLUTION SETTING DATE OF PUBLIC HEARING FOR VACATION OF ELECTRIC UTILITY EASEMENT AT 4506 LINCOLN WAY FOR THE CITY OF AMES,IOWA WHEREAS,the owner of 4506 Lincoln Way is Kum&Go, LC; and, WHEREAS, as part of the reconstruction of the Kum& Go convenience store at 4506 Lincoln Way, the electric utility transformer and buried electric line feeding the transformer were relocated on the site to accommodate the change in the site layout; and, WHEREAS, the property owner has requested that the existing electric utility easement be vacated, and staff is coordinating with the owner to obtain a new electric utility easement to match the new site layout; and, WHEREAS, Ames Electric Services is the only utility named in the existing easement, and the only utility occupying the easement; and, WHEREAS, pursuant to Iowa Code section 364.7, it is necessary to provide notice and public hearing regarding the proposal of the City to dispose of its interest in this real property; and, WHEREAS, following notice and public hearing, the City will determine if this proposal is appropriate. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AMES,IOWA, THAT: 1. Pursuant to Iowa Code section 364.7, publication of notice regarding the proposed vacation of an electric utility easement and establishing a public hearing date regarding the proposal is required. 2. The public hearing regarding the proposal to consider vacation of the City's interest in an electric utility easement at 4506 Lincoln Way shall be held on October 24, 2017, at 6:00 p.m. 3.
