BACKGROUND: The Mortenson I Partnership has requested that the PUD Plan for the Fourth Addition to Willow Creek Estates be amended. This amendment calls for the construction of an outdoor pool facility, an associated bathhouse, and a common laundry facility for the residents of the project. This amendment does not increase the number of dwelling units, nor alter the location of buildings from the original PUD Plan approved by the City in 1974. Since this pool facility and bathhouse are amenities that were not originally included in the project, the security that has been deposited with the City will have to be altered to ensure that these new amenities are constructed. The revised plan documents that have been submitted to show this amendment provide a more concise illustration of the project. These plans will aid the City and the developer in establishing a record of the project for purposes of determining compliance with the plan. This amendment does not alter the the provision of municipal utilities to the project which has been approved as being adequate to serve this project. The Development Review Committee and the Planning and Zoning Commission have reviewed this request and have recommended that the amendment be approved. A copy of the original plan, as amended, plus a copy of the most recent plan are attached for your review. ALTERNATIVES: 1. The City Council can approve the amendment request for the Fourth Addition to Willow Creek Estates with the stipulation that security be provided to the City to ensure that the pool , bathhouse, and laundry facility are constructed. 2. The City Council can approve the amendment request with modifications. 3. The City Council can deny approval of the amendment request. 2 MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alter- native #1. This will approve the amendment request and also require that adequate security be provided to and maintained by the City to ensure that the pool , bathhouse, and laundry facility are constructed . This will be accomplished by maintaining the initial amount of the security ($320,000) even after some of the public and/or private improvements have been completed so as to substitute the value of the security for these new amenities that are now being proposed.
