RESOLUTION APPROVING THE AGREEMENT FOR CONSTRUCTION AND MAINTENANCE
OF IMPROVEMENTS ON LOT 1, WILLOW CREEK ESTATES FOURTH ADDITION
WHEREAS, the developer was required to submit to the City an agreement which
states the conditions for construction and maintenance of improvements in the
PUD portion of the plat as part of the approval of the Conceptual Development
Plan for Willow Creek Estates Fourth Addition; and
WHEREAS, an agreement has been submitted by the developer which has been
reviewed by City staff and found to meet the requirements of the City in form
and content as follows:
1. The developer and its successors shall have the sole
responsibility for ownership and maintenance for all
private improvements to be constructed by the
developer on Lot 1.
2. The developer agrees to construct the private drive
to meet City specifications including 72 inches of
pavement thickness.
3. The developer agrees to hold the City harmless from
damages caused to the private drive as a result of
public transportation, including Cy-Ride Bus traffic.
4. The developer agrees to construct an all-weather
surface drive prior to framing construction on any
structure on Lot 1.
5. The developer agrees that no framing construction
will be permitted on any structure located on Lot 1
prior to the installation of water mains with
appropriate fire hydrants.
6. The developer agrees to submit to the City a bond for
$320,000 as security to pay for all of the costs
associated with public and private improvements on
Lot 1. This bond will be given to the City prior to
the occupancy of the first building constructed on
Lot 1 or the approval of the final plat, whichever
occurs first.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Ames,
Iowa, approves the Agreement for Construction and Maintenance of Improvements
on Lot 1, Willow Creek Estates Fourth Addition as attached hereto and made a
part hereof by this reference with the following stipulations adopted by the
City Council :

7. The City is in no way committed at this time to Cy-Ride
developing a route into this area or developing or
improving Mortensen Road.
8. The developer must sign a waiver of special assessment
requirements for the paving of Mortensen Road at this
time.
ADOPTED THIS 9th day of December, 1986.
