HomeMy WebLinkAboutA003 - Council Action Form dated February 26, 1985 (large maps not scanned) c S ITEM #:,_�.,2� DATE: 2/26/85 COUNCIL ACTION FORM SUBJECT: Approval of CDP/PUD for the Wildflower Development on Hickory Drive BACKGROUND: Mr. David Block and Mr. Clarke Pasley are proposing to create a six-lot, single-family residential PUD on a four-acre tract that is adjacent to Hickory Drive in the west portion of Ames . This PUD will contain six individually-owned lots, thus, the developers are proposing to replat Lots One and Two of the Inglis Subdivision. (See attached map. ) Street access to the proposed lots will be provided by a 24-foot private drive called Wildflower Drive. This drive will intersect with Hickory Drive which provides public access to the subdivision. The manner in which this drive will be created is through easements that are described on each lot that is affected by the drive. The Planning and Zoning Commission did express some concern about the issue of creating a private drive for the subdivision through the use of easements across the affected lots. Questions were raised regarding the responsibility for maintenance and the effect that these easements would have on the salability of the lots. The developers have created a series of restrictive covenants that address the issue of maintenance for the private drive. These covenants assign construction and maintenance responsibility of the private drive to four of six proposed lots. This responsibility is assigned to these lot owners in the form of covenants which may be dissolved by the lot owners after January 1 , 2005 . The developers are not proposing to create a Home Owners ' Association that wi l l have responsibility of maintenance for the private drive. This was also a concern to the Planning and Zoning Commission. The private drive, as proposed by the developers , will consist of a gravel surface. The Planning and Zoning Commission discussed the need for a paved-surface drive, but it was finally agreed that a gravel surface would suffice. The developers indicated that the gravel drive would be constructed to standards that would allow access for the City's emergency equipment. Water service to the subdivision will be provided by a public water main extension that will be located in a ten-foot public utility easement that will be provided in the private drive. Public sanitary sewer service is available to the subdivision from an 18-inch sewer main that crosses the property at the northwest corner. The individual lots will be provided with private sanitary sewer service that will ultimately connect to this public main. Storm sewer service will follow natural water courses and will ultimately discharge into Clear Creek which is adjacent to the subdivision. (See attached CDP/PUD maps. ) The Department of Planning and Housing and the Planning and Zoning Commission have recommended that the CDP/PUD for Wildflower Subdivision be approved with the following conditions: 2 1. Wildflower Drive must be constructed to City specifications where this drive intersects the public right-of-way of Hickory Drive. 2. Wildflower Drive must be constructed to a full surface width of 24 feet. 3. Private sanitary sewer and water services must be located in easements where these private services cross other private property. These easements must be provided and approved by the City at the time the Administrative Plat is processed. 4. Each lot created by this subdivision must be provided with individual water and sewer services to the public mains. 5. A storm water management plan must be submitted to the City Engineer for approval prior to issuance of building permits. ALTERNATIVES: 1. The City Council can approve the CDP/PUD of Wildflower Subdivision as recommended by the Planning and Zoning Commission with the stipulations as indicated. 2. The City Council can approve the CDP/PUD of Wildflower Subdivision with modifications. 3. The City Council can refer the request back to the Planning and Zoning Commission and direct that the concerns expressed about street paving and maintenance of the private improvements be resolved before Council approval is given. 4. The City Council can deny approval of the CDP/PUD. MANAGER'S RECOMMENDED ACTION: It is recommended by the City Manager that the City Council adopt Alternative #3. This will enable the developers and the Planning and Zoning Commission to resolve the concerns expressed about the construction of the private drive and the maintenance issue of these private improvements.
