Statement of Plan; Relationship to Larger Tract and Environs (a) This document, consisting of three (3) numbered pages and appendixes A through D for the development entitled "Wildflower", as approved by the Ames City Council , hereby constitutes the approved Planned Unit Development Plan for the Wildflower Development as required by Section 29 . 47 of the Municipal Code of the City of Ames, Iowa, for land described as: LOTS ONE (1) AND TWO (2), INGLIS SUBDIVISION (b) No alterations in existing features or changes in future buildings, structures or features as shown on the plan shall be permitted except in accordance with an approved amendment as may be granted within the standards and processes set out in the ordinances with the City of Ames , and any alteration undertaken contrary thereto shall constitute a violation of the zoning regulations of the City of Ames and be actionable as such. 2. Planning Requirements and Stipulations The following planning -requirements and stipulations are hereby incorporated into and made a part of the approved plan. (a) Density. The City of Ames Land Use Policy Plan designates the site of W71 lower Development as suitable for low-density residential development. The approved site plan delineates a maximum of eight dwelling units . No more than eight dwelling units shall be constructed and occupied on the site. No more than three unrelated persons shall be permitted to occupy any dwelling unit. (b) Placement of Buildings, Structures and Features. All buildings and structures shall be constructed within the confines of the "building envelopes " as described in the plan . Building envelopes are delineated as the boundary of each lot. All features including streets, parking areas and driveways shall be constructed generally as delineated on the plan. The design of each structure will be determined by the individual lot owner and approved through the approval mechanism established by the developer in the restrictive covenants. 2 (c) Parking. Parking will be provided on each lot with no parking allowed ® on Wildflower Drive. (d) Vehicular Access. Vehicular access shall be provided via Wildflower Drive, a public street, from Hickory Drive. (e) Utilities. All utilities will be public and constructed to standards established by the City of Ames. (f) Landscape Plan. The landscaping of Wildflower Development will be determined by the individual property owners. Landscaping along Wildflower Drive will be provided as depicted on 'the approved PUD Plan. Exact species and location will be submitted to the City staff for review at the time the Administrative Plat is submitted. Areas of the right-of-way adjacent to existing property owners may be sodded to minimize the impact of the right-of-way on their yard areas adjacent to the right-of-way for Wildflower Drive. The approved landscape plan will become a part of this document and identified as Appendix D. (g) Development Stipulations. 1. Lots Five (5) and Six (6) must acquire private easements for the sanitary sewer system. 2. It will be necessary to bond for street improvements if the Final Plat is submitted prior to construction of the improvements. 3. The restriction on construction below the 170-foot elevation established for the Inglis Subdivision will not apply to this PUD Plan. 3. Compliance and Enforcement A structure or activity undertaken on the subject land without building/zoning permits as required under the ordinances of this City or in conflict with the information and representation contained in and set out in this plan, shall be deemed a violation of the zoning ordinance of the City of Ames and actionable as such. 4. Ordinances Apply The requirements of all ordinances and regulations of the City of Ames apply to Wildflower Development and its development and all substantive and procedural requirements thereof unless in conflict with an express provision of this plan. - � 3 IN WITNESS of this plan having been submitted for approval by the developer and property owner and approved and adopted by the City Council of the City of Ames at its regular meeting of July 23, 1985, the said parties have caused their representatives to affix their signatures, to wit: THE W FL RTNERSHIP, Dev open BY: By: CITY ES B .
