Q RESTRICTIVE COVENANTS FOR
WHITE OAK SUBDIVISION
AMES, IOWA
WHEREAS, the City of Ames, Iowa is the titleholder of the real estate
contained in White Oak Subdivision, Ames, Iowa, and;
WHEREAS, for its own protection and for the benefit of subsequent owners
of the lots within said subdivision, the City of Ames, Iowa desires to
restrict the use thereof in certain particulars;
THEREFORE, the City of Ames, Iowa hereby covenants and agrees for
itself, its assigns, and successors in interest, as follows:
1. Lots A through N inclusive, that is, all the land in White Oak
Subdivision, shall be used only for purposes of existing or authorized
utilities, fences, gardens (vegetable or flower), trees, shrubs, lawns
or other plantings, and patio slabs of flagstone or similar material .
2. There shall be no re-grading or altering of the ground in any
way that would affect the natural flow of drainage as documented on the
Proposed Plat of Oakwood First Addition dated March, 1977 and on file
with the City of Ames and Engineering Plus, (Work Order Number 5-319-02).
3. Except for those permitted uses listed above, no other use may
be made of White Oak Subdivision, and no other structures may be con-
structed or installed on this land.
4. If the City of Ames, Iowa, its assigns and successors in
interest, shall violate or attempt to violate any of the covenants,
conditions, or restrictions herein expressed, it shall be lawful for any
other entity or person then owning any other lot in White Oak
Subdivision, Ames, Iowa, or the City of Ames, to prosecute any proceed-
ings at law or in equity or ameliorate such violations and to seek
injunctive relief or damages for such violation or for specific perfor-
mance in complying herewith.
5. These covenants, conditions or restrictions shall run with the
land and be binding on all parties and all persons or entities claiming
by, through or under them, until July 1, 2008, at which time the cove-
nants shall be automatically extended for successive 21-year periods
upon the filing of a verified claim by the owner of any one lot in the
subdivision, pursuant to Section 614.24, Code of Iowa.

On this 18th day of August A.D. , 1987 before
me, the undersigned, a Notary Public in and for the State of Iowa,
personally appeared F. Paul Goodland and Nancy Dionigi, to me personally
known, who, being by me duly sworn, did say that they are the Mayor and
DeputyCity Clerk, respectively, of the City of Ames, Iowa; that the seal
affixed to the foregoing instrument is the corporate seal of the said
municipal corporation and that the instrument was signed and sealed on
behalf of the municipal corporation by authority of its City Council , as
contained in the Resolution adopted by the City Council of the City of
Ames, Iowa, under Roll Call No. 87-235of the City Council of the City of
Ames, Iowa, on the 18th day of August 1987 , and that F.
Paul Goodland and Nancy Dionigi acknowledged the execution of the
instrument to be their voluntary act and deed and the voluntary'—iict and
deed of the municipal corporation, by it voluntarily executed^ '
