Paul Goodland, Mayor, And Members of the City Council Of The City of Ames, Iowa In Re: Disposal of Unwanted Land - White Oak Subdivision Dear Mayor Goodland and Council Members: You may recall your decision to dispose of a strip .of land in the Oakwood Subdivision so the City would not be responsible for mainte- , nance. The strip was subdivided into parcels to be deeded to owners of abutting lots in Oakwood. First, Addition. On January 19, a resolution proposing the .conveyance of those parcels and setting a date of hearing for February 2' was adopted. The hearing was held February 2nd and the resolution to authorize the deeds was adopted. However, .the notice of hearing that should have been published before January 29, 1.988, was not. To make a good record for future title examiners, .I ask that you repeat the legal process for disposition of these parcels. With this is a resolution to be adopted August 23 to propose the convey- ance and directing notice of hearing for September 13. Also enclosed are: a. the resolution to finally authorize the deeds, to. be adopted September 13, b. the 'form of notice to be published once; no sooner than August 25 and not later than September 8, and C. a sample form of deed. The willingness of the proposed grantees to accept the land is document- ed. After the resolution of September 13, the executed deeds, the resolutions and proof . of publication of the notice will be recorded, then the recorded-deeds mailed to the grantees: - Respectfully submitted, John R. Klaus �— - City Attorney AMES — THE CENTER OF IT ALL i RESOLUTION NO. f RESOLUTION AUTHORIZING QUIT CLAIM OF THE CITY INTEREST IN LOTS "A" THROUGH "N", IN WHITE OAK SUBDIVISION TO THE OWNERS OF ABUTTING LOTS; AND DIRECTING NOTICE AND HEARING WHEREAS, the land hereinafter described is useful to the City of Ames only to the extent of the easement recorded at Book. 241, p. 265 in the office of the Story County Recorder and the restrictive covenant record- ed at Book 241, p. 271, office of the Story County Ree-order; and, WHEREAS, it is deemed to be in the best interest of the City to Quit Claim its interest in said .land, except for the said easement and covenant, to the owners of abutting lots; WHEREAS, a resolution proposing said conveyance was enacted on August 23, 1988, and a public hearing following published notice has been held as required by law; NOW, THEREFORE, BE IT RESOLVED, that the City of Ames shall dispose of its interest in certain land, except for the said easement and covenant, by Quit Claim Deed to owners of abutting land as follows: - Property Owners in Oakwood First Addition To Receive Lots in White Oak Subdivision To Receive Oakwood Lots in First White Oak Addition Property Owner Current Address Subdivision Lot 1 Brian R. & Tanya Anderson 2412 Woodview Dr. Lot N Lot 2 John J. & Kristi J.
