Johnston, hereby state that I am an Attorney at Law, duly admitted to the practice of law in the State of Iowa, and a member of the firm of Newbrough, Johnston, Brewer, Maddux & Nadler, with offices at 612 Kellogg Avenue, Ames, Story County, Iowa. I further state that I have examined the Abstract of Title to the following-described real estate, to-wit: A Replat of Lot Three (3) , First Addition of W.G.G.C. Subdivision, Ames, Iowa, and of Lots One (1) and Two . (2) of Second Addition of W.G.G.C. The real estate has been subdivided and is now known as THIRD ADDITION OF W.G.G.C. SUBDIVISION, AMES, IOWA. PA., r -3- Based upon information within said Abstract of Title, it is my opinion that the fee simple title to said real estate is in Ford Street Development Company, an Iowa General Partnership, and that said real estate is free from encumbrances /excepting, however, a Mortgage to United Bank and Trust dated July 25, 1989, and filed in the office of the Recorder of Story County, Iowa, on July 27, 1989, in Book 370 at page 5, and a Mortgage to United Bank and Trust (now known as Firstar Bank Ames) dated July 25, 1989, and filed in said office of said county on May 25, 1990, in Book 390 at page 102 , and Special Assessments No. 25192D and No. 25203D; the property is subject to easements of record and to zoning ordinances of the City of Ames, Iowa.
