HomeMy WebLinkAboutA025 - Council Action Form dated August 23, 1994 Z 00 I ITEM #: DATE: 08123 4 COUNCIL ACTION FORM SUBJECT: Resolution Approving the List of Defects that Must be Corrected in Westwood Village Subdivision. ACTION FORM SUMMARY: Several corrections to the Final Plat of the Westwood Village Subdivision are necessary to bring the Final Plat and the PUD into conformance with each other. This is now necessary because of a pending sale of the property. Staff is recommending that the list of defects in this Council Action Form be corrected. BACKGROUND: When the owner of the Westwood Village PUD submitted the PUD Plan to the City for amendment in 1992, there were several items that were identified as needing to be corrected on the Final Plat of the property. These items are listed as follows: 1. The 20 foot wide driveway easement on existing Lot 5 must be moved to coincide with where the existing drive aisle has been constructed. 2. The internal pedestrian walkways must be included in cross easements, where the owners of the various lots have a right of pedestrian movement on the entire walk system. At the present, the walks have been dedicated to the Homeowner Associations, this needs to be redone. 3. All City-owned water mains, sanitary sewer mains and electrical utility infrastructure, located within the property, must have an easement granted to the City where these mains and infrastructure are located. 4. Areas of open space adjacent to Lot 6 and also on Lot 3 and Lot 2, must be reserved as open space and recreation areas for the benefit of all owners within the property. The above listed items are the defects that must be corrected on the revised Final Plat of Westwood Village Subdivision. (A copy of the existing Final Plat, showing these defects in concept is attached to this Council Action Form.) ALTERNATIVES: 1. The City Council can approve the list of defects and direct that these defects be corrected on a revised Final Plat. 2. The City Council can table action on this item and refer it back to City staff for additional information. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative #1. This will approve the list of defects on the existing plat of Westwood Village Subdivision and direct that these defects be corrected. The City Council will likely take action on the corrected Final Plat of Westwood Village Subdivision at the City Council meeting of September 9, 1994.
