RESOLUTION NO. 17-373
RESOLUTION APPROVING VACATION OF EASEMENT FOR PUBLIC BIKE PATH
BETWEEN THE CITY OF AMES AND THE AMES COMMUNITY SCHOOL DISTRICT
WITHIN AMES MIDDLE SCHOOL PROPERTY
FOR THE CITY OF AMES, IOWA
WHEREAS, the Ames School District, as part of the platting process for the Ames Middle
School,provided an easement on the public bike path within the Middle School site; and,
WHEREAS, with the expansion of the Middle School track/football field area, the site was
required to conform to the City's Post-Construction Storm Water Ordinance; and,
WHEREAS, in order to meet those requirements, the existing storm water facility was extended
into the existing bike path; and,
WHEREAS, the Ames School District will be relocating the path as part of this project in order
to accommodate the expansion of the storm water facility, and the new path will have a new easement
placed over it, and the existing easement needs to be vacated; and,
WHEREAS,vacation of the easement is in the best interest of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
AMES,IOWA THAT:
1. Pursuant to Iowa Code Section 364.7, publication of notice regarding the proposed
vacation of the bike path easement and establishing a public hearing date regarding the proposal has
been made.
2. The public hearing regarding the disposition of the property is hereby closed.
3. A public bike path easement across the following described land is hereby vacated:
The area proposed to be vacated is legally described as: A PART OF AN EXISTING
15.00 FOOT WIDE PUBLIC TRAIL EASEMENT, AS SHOWN ON THE FINAL
PLAT, BEING A PART OF LOT 1, AMES MIDDLE SCHOOL 2003, PLAT 3, AN
OFFICIAL PLAT IN THE CITY OF AMES, STORY COUNTY, IOWA MORE
PARTICULARLY DESCRIBED AS: COMMENCING AT THE NORTHWEST
CORNER OF SAID LOT 1, THENCE SOUTH 00°14'39"WEST ALONG THE WEST
LINE OF SAID LOT 1, A DISTANCE OF 540.88 FEET; THENCE SOUTH 55°12'42"
EAST, 181.40 FEET TO THE NORTH LINE OF SAID EXISTING TRAIL,
EASEMENT AND TO THE POINT OF BEGINNING; THENCE SOUTH 04°10'34"
EAST, 15.02 FEET TO THE SOUTH LINE OF SAID TRAIL EASEMENT; THENCE
WESTERLY ALONG SAID SOUTH LINE AND ALONG A CURVE CONCAVE
SOUTHERLY WHOSE RADIUS IS 23.45 FEET, WHOSE ARC LENGTH IS 33.18
FEET AND WHOSE CHORD BEARS SOUTH 41°57'32" WEST, 30.48 FEET;
THENCE SOUTH 05047'25" WEST CONTINUING ALONG SAID SOUTH LINE,
47.47 FEET; THENCE SOUTH 63°38'18" WEST, 6.16 FEET; THENCE
SOUTHWESTERLY ALONG A CURVE CONCAVE NORTHWESTERLY WHOSE
RADIUS IS 38.50 FEET, WHOSE ARC LENGTH IS 26.22 FEET AND WHOSE
CHORD BEARS SOUTH 83008'46"WEST, 25.71 FEET TO THE NORTH LINE OF
SAID TRAIL EASEMENT; THENCE EASTERLY ALONG SAID NORTH LINE
AND ALONG A CURVE CONCAVE NORTHERLY WHOSE RADIUS IS 15.00
FEET, WHOSE ARC LENGTH IS 23.87 FEET AND WHOSE CHORD BEARS
NORTH 51°22'51" EAST, 21.43 FEET; THENCE NORTH 05°47'07" EAST
CONTINUING ALONG SAID NORTH LINE, 40.95 FEET; THENCE NORTHERLY
CONTINUING ALONG SAID NORTH LINE AND ALONG A CURVE CONCAVE
EASTERLY WHOSE RADIUS IS 38.45 FEET, WHOSE ARC LENGTH IS 54.56
FEET AND WHOSE CHORD BEARS NORTH 43°08'32"EAST,50.10 FEET TO THE
POINT OF BEGINNING AND CONTAINING 0.03 ACRES (1,478 S.F.).
