RIGHT OF WAY PERMIT AND EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
That Phil Coy and Sons, a partnership composed of Jack Coy and
Richard Coy, and Broadmoor Enterprises, Inc. , an Iowa Corporation,
having its principal place of business in the City of Ames, Story County,
Iowa, for and in consideration of the sum of One Dollar, receipt of which
is hereby acknowledged, does hereby grant to the City of Ames, Story
County, Iowa, its successors and assigns:
1. The perpetual right to construct, reconstruct, operate and main-
tain electric lines, consisting of poles, wires, cables, conduits, fixtures,
anchors and other similar equipment, including the right to trim or remove
trees within such area where necessary to secure clearance of four feet
from the wires or poles.
2. The perpetual right to construct, reconstruct, alter, operate
and maintain water line and appurtenances thereto, sanitary sewers and
appurtenances thereto, and storm sewers and appurtenances thereto.
3. The perpetual right to construct, reconstruct, alter, operate
and maintain telephone wires, poles, cable risers and appurtenances
thereto.
4. The perpetual right to construct, reconstruct , alter, operate
and maintain gas lines and appurtenances thereto, together with the right
to extend to telegraph, telephone, electric, or power companies or any
company the right to use separately or jointly with the City of Ames, the
areas included in this easement for the purposes above enumerated, over,
upon, across .or under the following described real estate situated in the
County of Story, State of Iowa, to-wit:
That part of Lot 6 described as a 10 foot strip parallel to and ad-
jacent to and lying North and the Northwest of a line described as com-
mencing at the Northeasterly corner of said Lot 6, thence South 30024'
45" West, 100. 8 feet, thence North 89°24'55" West 55. 0 feet;
A 10 foot wide strip the centerline of which is the boundary line
between Lots 7 and 8 and extending the entire length of said boundary
line;
A 10 foot wide strip parallel to and adjacent to and lying South of
the Northerly boundary lines of Lots 8 and 9;
A 10 foot wide strip parallel to and adjacent to'and lying South-
easterly of the Northwesterly boundary lines of Lots 9, 10, 11, 12, 14,
15 and 16;

A 10 foot wide strip parallel to and adjacent to and lying North-
easterly of the Southwesterly boundary line of Lot 15;
That part of Lot 9 described as a 5 foot wide strip parallel to and
adjacent to the boundary line between Lots 9 and 8 and extending the en-
tire length of said boundary line;
A 20 foot wide strip the centerline of which is the boundary line
between Lots. 10 and 11 and extending the entire length of said boundary
line;
A 10 foot wide strip the centerline of which is the boundary line
between Lots 15 and 16 and extending the entire length of said boundary
line;
A tract described as beginning at the Southwest corner of Lot 10;
thence North 40°20' East, 60 feet; thence Southeasterly to a point on the
South line of said Lot 10 which is 80 feet South 83° East of the Southwest
corner of said Lot 10; thence North 83° West, 80 feet along the South
line of said Lot 10 to the point of beginning;
The East 10 feet of Lots 1, 2, 3, 4, 5, 7 and 8;
The South 5 feet of Lot 5; and
The North 5 feet of Lots 13 and 19
All in Second Addition, Westbrook Subdivision of Ames, Iowa.
The foregoing rights are granted upon the express condition that
the City of Ames will assume responsibility for all damage to the above
described property caused by the City's failure to use due care in the
exercise of its granted right.
