SUBJECT: Final plat of Thies Subdivision.
BACKGROUND:
The final plat of Thies Subdivision has been submitted and reviewed by
staff. This development is located at the northeast corner of East Lincoln
Way and Bell Avenue and is a replat of a portion of Spencer's 1st
Subdivision. All platting requirements have been completed and are
acceptable with the exception of the street paving requirements. During the
review of the Administrative Plat for this subdivision, it was noted that
all utilities had previously been constructed and the street graded but
street surfacing was not completed. This work was completed under the
previous subdivision (Spencer's 1st) platted in 1974. In accordance with
the City Council policy established by Resolution #76-205, a copy of which
is attached, and the fact that Lots 1 and 2 are currently developed, the
developer was requested to submit a request for paving and waiver of any
deficiencies in order to provide for the street paving. Correspondence was
subsequently received from the owner's attorney stating they did not feel
that they should have to pay for the street surfacing as a requirement of
platting and thus, submitted the final plat without provision for the
paving. Attached are copies of correspondence dealing with the street
surfacing question.
The most recent example of applying the policy of requiring street paving
adjacent to industrial/commerical developments occurred earlier this fall in
Dayton Road Development Subdivision. The owners were required to submit a
request for paving and waiver of deficiency to pave Watt Street from Dayton
Raod east to the east line of the developed lot (Des Moines Asphalt Plant) .
They have complied with the requirement and the paving is scheduled for next
spring.
ALTERNATIVES:
1. Reject the final plat in accordance with the established policy
requiring street surface adjacent to developed property.
2. Accept the plat as submitted and estabish a new policy relating to
street surfacing in industrial/commercial subdivisions.
MANAGER'S RECOMMENDED ACTION:
It is recommended by the City Manager that the City Council adopt
alternative number 1 above.
