In reference to Mr. Holm's letter concerning the public improvement
requirements for Thies Subdivision, I must take exception to several of his
statement. I was not involved in the platting of Spencer's First Addition
in 1974 so I cannot respond as to why the paving of Ford Street (now Bell
Avenue) was not required. I have been told that paving was not required in
commercial/industrial subdivisions at that time.
So that any confusion is eliminated, I have attached a plat of the original
layout of Thies Subdivision submitted in 1978. As you can see the original
layout called for a cul-de-sac to be extended from what was then Ford
Street. The reason the original platting requirements for the 1978
subdivision were changed resulted from the fact that the street paving and
associated storm sewer were to be included in a street assessment program
that also included paving Ford Street on the west side of the subdivision.
Prior to final action on the plat, the assessment of the cul-de-sac was
dropped from the paving assessment program. A copy of my May 11, 1978
letter to Mr. Thies is attached and should help explain the situation. The
paving of Ford Street adjacent to the subdivision went to a public hearing
and the City Council rejected the project. The inclusion of the paving of
Ford Street in the street assessment program was probably the reason that no
requirements for paving of Ford Street were included in the subdivision
requirements.
As far as Mr. Holm's statement that the paving was not included in the
platting requirements until September 6th, that is the appropriate time
since the administrative plat was processed at that time. The processing of
the Conceptual Development Plan by the Planning and Zoning Commission and
the City Council does not include items related to public improvement
requirements.
As you know, the established "policy" of requiring street surfacing next to
developed commercial/industrial properties is in conformance with Resolution
#76-205 passed by the City Council. Again, the statement related to waiting
until the final stages of the platting, is not approriate since it was
related to the developer in the review of the administrative plat.
As far as review and submittal of the final plat to the City Council, please
advise if you wish to proceed as the owners have requested. Obviously the
Council can change their policy as it relates to paving of streets for
commercial/industrial subdivisions if they wish to do so.
