Home My WebLink AboutA012 - Resolution No. 00-176 adopted April 25, 2000 CITY OF AMES,IOWA RESOLUTION NO. 00-176 Approving First Addition, Terra Firma Subdivision,Ames,Iowa Whereas the City Council has authority, as described in article III, section 38A of the Con- stitution of the State of Iowa and in chapters 354 and 355 of the Code of Iowa (2000), to review and ap- prove subdivision plats within the corporate limits; Whereas there has been submitted to the City Council of the City of Ames, Iowa, a plat of the real property hereinafter described and designated as "First Addition, Terra Firma Sudvivision, Ames,Iowa"a replat of: The North 54 feet of Lot 14, Parker's Addition to Ames, Iowa, except that portion sold off the West end for railway purposes(and also known as Story County Parcel N°09-09- 131-090,locally known as 221 Stanton Avenue, Ames,Iowa); AND The South 58.6 feet of the North 112.6 feet of Lot 14 in Parker's Addition to Ames, Iowa, and a 30 foot strip of abandoned Fort Dodge,Des Moines&Southern Railroad Company right of way across the North 112.6 feet of Lot 14 in Parker's Addition to Ames, Iowa (and also known as Story County Parcel N°09-09-131-100,locally known as 223 Stanton Avenue, Ames,Iowa); AND The North 58 feet of the South 83.7 feet of Lot 14 in Parker's Addition to Ames, Iowa (and also known as Story County Parcel N°09-09-131-110, locally known as 229 Stanton Avenue, Ames,Iowa);AND The South 25 feet of Lot 14, except the West 15 feet thereof; and the North 32.3 feet of Lot 15,except the West 15 feet thereof; all in Parker's Addition to Ames, Iowa(and also known as Story County Parcel N°09-09-131-120, locally known as 301 Stanton Avenue, Ames,Iowa); which may also be described as: The North 112.6 feet of Lot 14, Parker's Addition, in the City of Ames, Story County, Iowa, except that portion which lies Northwesterly of the northwesterly line of the right-of-way of the Fort Dodge, Des Moines & Southern Railway Company as origi- nally located thereon; AND the South 83.7 feet of said Lot 14, except the right-of-way of the Fort Dodge, Des Moines & Southern Railway Company as originally located thereon; AND the North 32.3 feet of Lot 15,in said Parker's Addition,except the right- of-way of the Fort Dodge, Des Moines& Southern Railway Company as originally lo- cated thereon; ALL in the Northwest '/4 of the Northeast '/4 of Section 9, Township 83 North,Range 24 West of the 5th P.M.,in the City of Ames, Story County,Iowa and more particularly described as follows: Beginning at the Northeast corner of Lot 14, Parker's Addition, in the City of Ames, Story County, Iowa; thence North 89' 46' 08" West, 174.81 feet along the north line of said Lot 14;thence Southwesterly, along the northwesterly line of the Fort Dodge, Des Moines & Southern abandoned Railway and along a 490 foot radius curve, concave southeasterly, an arc distance of 50.72 feet (the long chord bears South 17' 10' 05" West, 50.69 feet); thence South 00'00' 38" East, 64.00 feet along the west line of Lot 14;thence South 89145' 10"East, 18.45 feet along the north line of the South 83.7 feet of Lot 14; thence Southwesterly, along the southeasterly line of the Fort Dodge, Des Moines & Southern abandoned Railway and along a 460 foot radius curve, concave southeasterly, an arc distance of 56.37 feet (the long chord bears South 030 30' 00" Itl�i I� West, 56.33 feet); thence South 00' 00' 38" East, 58.03 feet along the east line of the FJF 200002241711 Page 1 00 - 04271 (q) FIRSTADDITIDN, TERRA FIRMASUBDIVISION,AMES, IowA Page 2 Fort Dodge, Des Moines & Southern abandoned Railway; thence South 00' 05' 21" West, 2.04 feet continuing along the east line of the Fort Dodge, Des Moines & South- ern abandoned Railway;thence South 890 55' 44" East, 174.74 feet along the south line of the North 32.3 feet of Lot 15, Parker's Addition, in the City of Ames, Story County, Iowa;thence North 00'00' 00"East, 228.32 feet along the west line of Stanton Avenue, to the Point of Beginning. Whereas Terra Firma, L.P., an Iowa limited partnership, as sole owner of said real property, has caused to be executed and acknowledged an instrument consenting to said plat; Whereas said plat has been reviewed by the Planning and Housing Department and com- plies with all requirements of chapters 354 and 355 of the Code of Iowa and the platting ordinance of the City of Ames, Iowa; Whereas the City Council deems this resolution appropriate, necessary, and in the interests of the citizens of the City of Ames and thereby to protect, preserve, and improve the rights, privileges, property,peace, safety, health,welfare,comfort,and convenience of the City and its residents, all as pro- vided in section 364.1 of the Code of Iowa(2000); Now,THEREFORE,BE IT RESOLVED by the City Council of Ames,Iowa: 1. The City Council accepts and approves as an official subdivision plat to be known as "First Addi- tion, Terra Firma Subdivision, Ames, Iowa" the subdivision plat of the real property described herein above. 2. The City Council does hereby accept for utility purposes all other land designated on said plat for easement purposes. 3. The Mayor and Clerk are authorized and directed to certify and affix to said plat a tnie copy of this resolution in accordance with sections 354.8 of the Code of Iowa. 4. All other resolutions or parts of resolutions in conflict with this resolution are hereby repealed. If any section,provision, or part of this resolution shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the resolution or action of the City Council as a whole or any section,provision, or part thereof not adjudged invalid or unconstitutional. This resolution shall be in full force and effect from and after the date of its approval as provided by law. Council Member Wirth seconded the motion to adopt. Upon consideration, the Mayor put the question on the motion. The roll was called and the Council Members voted as follows: Yes: Campbell, Cross, Goodhue, Hoffman,Quirmbach, Wirth No: None Absent/Abstain: None The Mayor declared the resolution adopted.
