HomeMy WebLinkAboutA011 - Council Action Form dated April 25, 2000 I- Ir E" L ITEM # _ DATE 04/25/00 COUNCIL ACTION FORM SUBJECT: RESOLUTION APPROVING THE FINAL PLAT OF TERRA FIRMA SUBDIVISION, FIRST ADDITION ACTION FORM SUMMARY: The applicants are requesting that the City Council approve the Final Plat of Terra Firma Subdivision, First Addition. Staff is recommending that this Final Plat be approved. BACKGROUND: The applicants, Terra Firma, L.P., are requesting that the City Council approve the Final Plat for Terra Firma Subdivision, First Addition. The proposed plat involves the re-division of Lot 14 and a part of Lot 15 of Parker's Addition. The proposed plat will create a two-lot subdivision. It is the developer's intent to construct an 18-unit apartment building on Lot 1, and a duplex will remain on Lot 2. Currently, there are three residential structures on the proposed Lot 1, which will be removed for the construction of the apartment building. The Subdivision Ordinance states in Section 23.107 that all plats of land must also comply with all other applicable City regulations, including the Zoning Ordinance. In this case there will be three residential structures remaining on Lot 1 until mid August due to leases, which is a violation of Section 29.35. That states that more than one single family or two family residential structure on the same platted lot is prohibited. In addition, the south residential structure on Lot 1 does not meet the minimum side yard setback for the zoning district. In order to resolve this inconsistency with the Zoning Ordinance regulations, the applicants have sought and received two variances from the Zoning Board of Adjustment to be allowed to retain the three residential structures on Lot 1 until August 15, 2000. By that date the three existing residential structures shall be removed. ANALYSIS: The staff has reviewed the Final Plat for Terra Firma Subdivision, First Addition and has determined that this plat complies with the requirements of the City. The two variances from the Zoning Board of Adjustment allows staff to state that this plat would be in compliance with the zoning regulations of the City. No public improvements are required as part of this subdivision. In all other respects, the Final Plat meets the requirements of the City. Staff is recommending that this plat be approved. (A copy of the Final Plat is attached.) ALTERNATIVES: 1. The City Council can approve the Final Plat for Terra Firma Subdivision, First Addition. 2. The City Council can deny approval of the Final Plat for Terra Firma Subdivision, First Addition. 3. The City Council can approve the Final Plat Addition with modifications. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative #1. This action will approve the Final Plat Terra Firma Subdivision, First Addition. This will allow the developer to proceed with the redevelopment of Lot 2. COUNCIL ACTION: Attachment 2
