HomeMy WebLinkAboutA013 - Council Action Form dated August 25, 1998 Item # a�6 Date: August 25, 1998 COUNCIL ACTION FORM SUBJECT: APPROVAL OF FINAL PLAT AND DEVELOPMENT AGREEMENT FOR TARGET ADDITION IN AMES, IOWA. BACKGROUND: The owners of the property east of South Duff Avenue, south of Southeast 3Id Street and north of Southeast 5t" Street have submitted a Final Plat to the City of Ames to be called Target Addition to the City of Ames. This represents a three lot subdivision that will ultimately be the location for the development of a new Target facility and associated parking improvements to be located on Lots 2 and 3 of the Final Plat. Lot 1 will be the location for a free-standing commercial use. ANALYSIS: As part of the review of this Final Plat staff has determined that the requirements of the City of Ames for the review and approval of a Final Plat have been met. As part of this review, staff has determined that the applicant, Dayton Hudson Corporation, has not secured a permit from the Iowa Department of Transportation (IDOT) for the construction of the street intersection improvements of Southeast Third Street with Duff Avenue. City staff and the engineering consultant representing Dayton Hudson Corporation have met recently with the staff of the IDOT to determine what changes, if any, are needed to the Final Plat for the street intersection improvements that would allow for the IDOT to issue the permit. Concern has been expressed by IDOT staff with respect to the two existing driveways that provide access from Duff Avenue to proposed Lot 1 and proposed Lot 3. The IDOT staff has indicated a desire to have the driveway to proposed Lot 1 closed. Additionally, there has been some concern expressed by IDOT with respect to the alignment of the intersection of Southeast 3rd Street with the intersection of South 3rd Street on the west side of Duff Avenue. As part of the review and approval of the Conceptual Development Plan of this subdivision, Dayton Hudson Corporation has agreed to driveway restrictions and off-site improvements relative to the intersection of Southeast 3rd Street and Duff Avenue and bike path improvements along Southeast 5t" Street. A development agreement has been prepared that documents these restrictions and responsibilities and this agreement has been signed by Dayton Hudson Corporation. STAFF COMMENTS: The intersection of Southeast 3rd Street with Duff Avenue is essential to the validity of the Final Plat proposed for approval by Dayton Hudson Corporation. Therefore, it is essential that the concerns that have been expressed by the IDOT with respect to the driveways and the intersection of Southeast 3rd Street be resolved prior to the approval of the Final Plat. Continued efforts are occurring to meet with MOT staff to resolve these problems. As of the writing of this Action Form, this meeting has not occurred and therefore these problems have yet to be solved. Staff believes that two possible courses of action can occur with respect to action on this Final Plat. 1. Require from Dayton Hudson a written commitment that indicates whatever design changes and improvements to the intersection of Southeast 3rd Street with Duff Avenue, and whatever restrictions are required for the driveways to Lot 1 and Lot 3, all as specified by the [DOT, will be agreed to by Dayton Hudson Corporation. 2. Require that the design changes and improvements to the intersection of Southeast 3rd Street with Duff Avenue and the restrictions to the driveways for Lot 1 and Lot 3 have been resolved between the IDOT and Dayton Hudson Corporation, and that written verification of this resolution from the IDOT has been provided to the City. The developers have been made aware of the dollar amount of the guarantees necessary to assure the completion of the public improvements. As of the writing of this Action Form, the actual receipt of the guarantee in the amount of $300,000 has not been received. A development agreement detailing the improvements, developers' obligations, and City obligations has been signed and submitted for approval with the Final Plat. ALTERNATIVES: 1. The City Council can approve the Final Plat for the Target Addition to the City of Ames and the Development Agreement between Dayton Hudson Corporation and the City of Ames only if Dayton Hudson Corporation has complied with the following stipulations: a. That prior to action by the City Council on this Final Plat, Dayton Hudson has provided to the City a copy of a written commitment to the Iowa Department of Transportation that Dayton Hudson will comply with whatever design changes and intersection improvements and driveway restrictions that the IDOT specifies; or b. That Dayton Hudson Corporation provides to the City written verification from the IDOT that the concerns with respect to the design changes and intersection improvements at Southeast 3rd Street with Duff Avenue, and the restrictions to the driveways for Lot 1 and Lot 3 have been resolved to the satisfaction of the IDOT. C. That Dayton Hudson has provided to the City a financial guaranty for the installation of the Plat improvements in the amount of $300,000. 2. The City Council can table action on the request to approve the Final Plat and the Development Agreement to the Target Addition to the City of Ames and refer this request back to staff. 3. The City Council can deny the request to approve the Final Plat for the Target Addition to the City of Ames and deny the Development Agreement. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative #1. This will approve the Final Plat of the Target Addition to the City of Ames and the Development Agreement between Dayton Hudson Corporation and the City of Ames. In the event that the stipulations as listed in Alternative #1 have not been fulfilled, the City Manager recommends that the City council adopt Alternative #2. COUNCIL ACTION:
