Munn Lumber Company, , a.corporation organized and existing under the laws of the State of Iowa and`havings its principal place of business in Story County, Iowa, in consideration of One Dollar and other good and valuable consideration, does -.hereby grant unto the City of Ames, Iowa, a municipal corporation, its suc- cessors and assigns, the perpetual right to construct, reconstruct, maintain and.use electric lines, consisting of poles, wires, cables, conduits, fixtures, anchors and similar equipment, including the right to trim or remove trees within such area where necessary to secure a clearance of four feet from the wires or poles, together with the right to extend to telephone, telegraph, electric or power companies, the right to use separately or jointly with the City of Ames, Iowa, the areas included•in this.easement for the -purpose of extending utility services over, upon, across or under the following de- scribed real estate, situated in the County of Story, State of Iowa, to-wit: The North 5 feet.of Lots 8, 9, 10, 11 and 12 and the frontage of Lots 1 to 12, inclusive, abutting on a public right of way to a depth of 5 feet all in Sunset Rock First Addition to the City of Ames, Iowa, as shown on the Final Plat thereof at- tacked hereto. H. L. Munn Lumber Company does hereby further grant to the City of Ames, Iowa, its successors and assigns, the perpetual right to construct, reconstruct, maintain and use a water distribution main over, upon, across and under the East 10 feet of Lot 3 and the West 10 feet of Lot 2 in Sunset Rock First Addition to the City of Ames, Iowa, as shown on the Final Plat thereof attached hereto. H. L. Munn Lumber Company does hereby further grant to Iowa Electric Light and Power Company, its successors and assigns, the per- petual right to construct, reconstruct, maintain and use a pipe line for the transportation of gas over, upon, across and under that part of Lots I and 2 in Sunset Rock First Addition to the City of Ames, Iowa, described as follows: The West 10 feet of the South 105 feet of said Lot 2 and a strip of land 5 feet either side of a line described as follows: -q is Beginning at a point on the West line of said Lot 2 which is m 0 99. 5 feet North of the Southwest corner thereof; thence South 89'21' East 62. 0 feet; thence North 23 047' East 49. 6 M 000 feet to a point on the Northeasterly line of said Lot 2 which ;� c is 59.0 feet Southeasterly of the Northeast corner thereof; "' co :'0 thence North 23°47' East 32. 6 feet; thence North 4°27' West ¢ v - 15. 6 feet to a point on the Northeasterly side of said Lot 1 which is 35. 7 feet South 33°28' East from the Southeaster- �K ly right-of-way line of Garfield Avenue/Phoenix Street. The foregoing rights are granted upon the express condition that the grantees will assume responsibility for all damage to the above described property caused by,their exercise of the granted rights.
