COUNCIL ACTION FORM
SUBJECT: RESOLUTION APPROVING THE REVISED FINAL PLAT FOR STONE
BROOKE SUBDIVISION, 6T" ADDITION
ACTION FORM SUMMARY: The applicant, Stone Brooke, LLC, is requesting that the City
Council approve the Final Plat of the Stone Brooke Subdivision, 6th Addition. This is the
same subdivision that the City Council has previously approved. The ownership information
was incorrect. It was previously approved as Stone Brooke Partnership when the actual
owners are Stone Brooke, LLC.
Staff is recommending that the Final Plat be approved.
BACKGROUND:
The applicant, Stone Brooke, LLC, is requesting that the City Council approve the Final
Plat of the Stone Brooke Subdivision, 6th Addition. This plat was previously approved by
the City Council on July 25, 2000.
The plat that was previously approved was submitted by Stone Brooke Partnership, when
in fact the owner of the property was Stone Brooke LLC. When the plat documents were
taken to the Story County Recorder's office for recording, they refused to record the
documents since they indicated the wrong owners. The plat documents have been
corrected to indicate the actual owners as being Stone Brooke, LLC. They are now
seeking approval of this Final Plat.
ANALYSIS:
The Final Plat of Stone Brooke Subdivision, 61h Addition is the same Final Plat that was
previously approved by the City Council in all respects. Staff is recommending that this
Final Plat be approved. (A copy of the Final Plat is attached.)
ALTERNATIVES:
1. The City Council can approve the revised Final Plat of Stone Brooke Subdivision, 6th
Addition.
2. The City Council can deny approval of the revised Final Plat of the Stone Brooke
Subdivision, 6"Addition.
3. The City Council can approve the Final Plat of Stone Brooke Subdivision, 6th Addition
with modifications.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council approve Alternative #1.
This will approve the revised Final Plat of the Stone Brooke Subdivision, 6" Addition. This
approval will result in the Final Plat being recorded in the Story County Recorder's office
and allow for the sale of lots to homebuyers
