SURFACE WATER FLOWAGE EASEMENTS
I, Bill Allen, Manager of the Stone Brooke, L.L.C., of Ames, Story County, Iowa, in
consideration of the sum of One Dollar, receipt of which is hereby acknowledged, do
hereby grant to the City of Ames, Iowa, a municipal corporation, its successors and
assigns, the perpetual right to construct, reconstruct, maintain and use it surface water
flowage across the following described real estate:
Beginning at the northwest corner of lot 1; thence S89002'40"E, 430.65 feet along the
north lines of lots 1, 2, 3, 4, 5, 6, 7 and 8 to the northeast corner of said lot 8, said point
also being the northern most corner of lot 9; thence S26°10'50"E, 100.71 feet along the
northeasterly line of said lot 9 to the northeast corner of lot 10; thence S00°57'20"W,
180.75 feet along the east lines of lots 10 and 11 to the southeast corner of said lot 11;
thence N 11 o25'43"W, 166.68 feet to a point; thence N33ol 1'22"W, 76.68 feet to a point;
thence N77o09'22"W, 92.76 feet to a point; thence N89002'40"W, 164.00 feet to a point;
thence N79o07'41"W, 145.17 feet to the point of beginning
And
Outlot X,
all within Stone Brooke Subdivision, Sixth Addition, City of Ames, Iowa.
The foregoing right is granted upon the express condition that the users of the
granted right will assume liability for all damage to the hereinbefore described real estate
and adjoining real estate caused by failure to use due care in the exercise of the granted
right.

this instrument to be executed this 17th day of July, 2000.

L.L.C., and that said instrument was signed on behalf of the said Stone Brooke, L.L.C. by
authority of its Manger, and said Manager acknowledged the execution of said instrument
to be the voluntary act and deed of said StonABr ke, L.L.C. it ntarily executed.
