SANITARY SEWER, WATER MAIN AND STORM SEWER EASEMENT
I, Bill Allen, Partner of the Stone Brooke Partnership, of Ames,
Story County, Iowa, in consideration of the sum of One Dollar, receipt
of which is hereby acknowledged, do hereby grant to the City of Agnes,
Iowa, a municipal corporation, its successors and assigns, the perpetual
right to construct, reconstruct, maintain and use its sanitary sewer,
water main and storm sewer across the following described real estate:
Beginning at the most northerly corner of lot 29; thence
N38 '48133"W, 60.00 feet to a point; thence N51 '11127"E, 35.00 feet
to a point; thence S38 '4813311E, 60.00 feet to a point; thence
S51 °11127"W, 35.00 feet to the point of beginning.
all within Stone Brooke Subdivision Fifth Addition, City of Ames,
Iowa.
. The foregoing right is granted upon the express condition that
the users of the granted right will assume liability for all damage
to the hereinbefore described real estate and.adjoining real estate
caused by failure to use due care in the exercise of the granted
right.
