WATER MAIN EASEMENT
I, Bill Allen, Partner of the Stone Brooke Partnership, of Ames,
Story County, Iowa, in consideration of the sum of One Dollar, receipt
.of which is hereby acknowledged, do hereby grant to the City of Ames,
Iowa, a municipal corporation, its successors and assigns, the perpetual
right to construct, reconstruct, maintain and use its water main across
the following described real estate:
A 10.00 feet wide easement that is centered on the following
described line:
Commencing as a point of reference at the northwest corner of lot
31: thence S0005712011W, 140.72 feet along the west line of said Lot
31 to the point of beginning; thence S89'02140"E, 50.00 feet to the -
point of terminus.
all within Stone Brooke Subdivision Fifth Addition, City of Ames, Iowa.
The foregoing right is granted upon the express condition that the
users of the granted right will assume liability for all damage to the
hereinbefore described real estate and adjoining real estate caused by
failure to use due care in the exercise of the granted right.
IN WITNESS WHEREOF, Bill Allen, Partner of the Stone Brooke Partnership,
