(OUTSIDE SBOOND ADDITION, SM4E BROOEE SUBDIVISION, AMES, IOWA)
The undersigned, Stone Brooke Partnership, of Ames, Story County,
V Iowa, and Wallace C. Schloerke and Janice F. Schloerke, husband and wife, in

i ' consideration of the sum of One Dollar ($1.00) the receipt of which is hereby

acknowledged, do hereby - grant to the City of Ames, Iowa, a municipal
corporation, its successors and assigns , a perpetual right to construct ,
reconstruct , maintain and use its storm sewer lines, consisting of all
underground storm sewer lines, connections, hook-ups and other similar
equipment or any part thereof, for the sole purpose of general storm sewer use,
together with the right to go upon the premises, make repairs, install lines,
connect to existing lines and to extend the said lines or mains to any other
property or location within the said easement area described below for the safe
operation of storm sewer lines upon, underground or adjacent to that real
estate as set out in the attached plat marked Schedule "A" and made a part
hereof, and more specifically described as:
A Ten (10) foot wide easement, across part of the East-half
(E 1/2) of the Northwest Quarter (NW 1/4) of Section 27 -
�� T84N -- R24W of the 5th P.M. , in the City of Ames, Story
it County, Iowa;' five (5) feet on each side of the following

"Commencing at the Northwest (N.W.) corner of Lot Nine (9),
in the Second Addition of Stone Brooke Subdivision, in the
City of Ames,, Story County, Iowa; thence S 6,f 30' 34" W,
62.08 feet to the Point of Beginning; thence N 160 29' 49"
E, 31.57 feet; thence N 880 14" 01" E, 153.34 feet; thence
N 430 14' 01" E, 13.00 feet to the Point of Ending."
The foregoing right is granted upon the express condition that the

I1City of Ames will assume liability for all damage to the herein described
property caused by the City's failure to use due care in its exercise of the

granted right.
