Dear Mayor Curtis and Council Members:
You may recall that on February 13, 1990, a resolution was passed
authorizing the City Attorney to proceed with litigation to establish
liability for the cost of further inspection and repair of defects that
were discovered in the sanitary sewer lines for Stonebrooke Second
Addition.
After commencement of the litigation, the parties were able to reach a
favorable agreement for mutual settlement of the case, the terms of which
require payment to the city of $4,000 by the defendants, in exchange for
which the City will dismiss its suit and release its claim for the cost of
.inspecting and repairing the affected segment of sewer.
The city has received payment in full from the defendants and it remains
for the City to release its claim for the costs of inspection and, repair.
A resolution has been prepared to authorize. release upon the payment, and
it is attached for your consideration.
