HomeMy WebLinkAboutA016 - Resolution No. 90-46 adopted February 13, 1990 � _ 9 RESOLUTION NO. 90-46 RESOLUTION AUTHORIZING LITIGATION PERTAINING TO STONEBROOKE SEWER WHEREAS, the City inspected the sanitary sewer in Stonebrooke Second Addition and the City Council accepted the installed sewer system by resolution on February 2, 1988; and WHEREAS, it was determined in September, 1988, by the Public Works Department that the sanitary sewer lines for Stonebrooke Second Addition are defective in that the laterals off the main, that is, the service lines to the lots, were connected to the main by means of hand sawing a roughly rectangular opening into the main line, while the City Code, Section 21.7 requires a round, smooth, machine drilled hole and specifically states that "no hand methods are allowed"; and WHEREAS, because of this defect, sewage leaks out and eventually the leaks may erode away a cavity around the connection and cause the connections to lose support to such extent that it will break off. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that the acceptance of the sanitary sewer for Stonebrooke Second Addition is hereby rescinded and litigation for declaratory judgment to establish liability for the cost of further inspection and repair of defects that have been discovered in the sewer system is hereby authorized.
