SUBJECT:
Request for reapproval of the Conceptual Development Plan (CDP) for Stone
Brooke Development.
BACKGROUND:
In March, 1980, by Resolution No. 80--111, the City Council approved the CDP/
PUD (Planned Unit' Development) for Phase I of the Stone Brooke Development.
Phase I is the southern portion of the development and contains 70 residential lots.
Although engineering work has been completed, the Administrative Plat was not
submitted within one (1) year after approval of the CDP as required by Section 32-1011
of the Municipal Code. - A map showing the Stone Brooke area and a letter from the
developers are .attached.
Since the Administrative Plat was not submitted within the prescribed time, it
is necessary that the City Council reaffirm their original approval. The CDP/PUD
has not been changed, and for that reason. it is not necessary to refer this item
to the Planning and Zoning Commission. A similar procedure was followed for the
Gateway Hills II development, which was originally approved on September 18, 1979,
and reapproved on September 30, 1980.
The current Subdivision Ordinance was enacted in April, 1978. Development was
occurring at that time and platting was normally a succession of CDP/Administrative
Plat/Final Plat steps within a relatively short span of time. The one-year
limitation from CDP to Administrative Plat caused no concern. The nondevelopment
economy of the last three years has created a similar predicament with other
developments in addition to Stone Brooke. With the economy coming to life the
City could be faced with additional requests to reapprove other_ CDPs. The staff
will compile a list of the plans, contact the various developers, and present a
"package" of CDPs for reapproval to City Council in the near future. Additionally,
there will be forwarded to the Planning and Zoning Commission a request for recon-
sideration of the one-year time limitation.
ALTERNATIVES:
1. To reaffirm the approval given in March, 1980, for Stone Brooke, Phase I.'
2. To refer this item to the Planning and Zoning' Commission.
MANAGER'S RECOMMENDED ACTION:
.It is recommended by the City Manager that the City Council reaffirm the approval
given in March, 1980.

Since it has been more than one year since the City Council approved the
conceptual development plan of the Stone Brooke project, located on .
Top-O-Hollow Road, we would like to submit the plan for reapproval.
The original plans have not been changed since your last approval. The
City Engineering staff has completed the necessary engineering work
pertaining to this project. We delayed this project after your last
approval due to economic conditions, now due to changing times we feel
that this project is feasible.
Since timing is of the essence we would like to ask for your approval
at this time.
