The North Five (5) Feet of Lot Eight (8) . 2. The South Five (5) feet of Lot Nine (9) 3. A triangular shaped easement, across part of Lot 44; Beginning at the Southwest (S .W. ) corner of Lot 44; thence N 00° 21' 35" E. , 9 . 07 feet; thence S 44° 38 ' 25" E. , 12. 83 feet; thence N 89° 38 ' 25" W, 9 . 07 feet to the Point of Beginning. 4. The Southwesterly Five (5) feet of Lot 59 5. The Northeasterly Five (5) feet of Lot 60 6. A triangular shaped easement, across part of Lot 67 ; Beginning at the Northwest (N.W. ) corner of Lot 67 ; thence S 89' 38 ' 25" E. , 9. 07 feet; thence S 45' 21 ' 35" W, 12. 83 feet; thence N 00' 21 ' 35" E, 9. 07 feet to the Point of Beginning. NOTE: This new storm sewer easement is intended to replace the existing easement shown in the existing abstract at' entry #14 and recorded in miscellaneous records Book #133 , Page 119 on December 3 , 1976. 10. A triangular shaped easement, across part of Outlot "E" ; Beginning at a point on the west line of Outlot "E", which is S 00° 21 ' 35" W, 23.15 feet from the Southwest (S.W. ) corner of Lot 73; thence S 00° 21' 35" W, 6. 86 feet; thence N 89° 04' 00" E, 17 .44 feet; thence N 69° 17 ' 25" W, 18. 60 feet to the Point of Beginning. The foregoing right is granted upon the express condition that the City of Ames will assume liability for all damage to the herein described property caused by the said City' s failure to use due care in its exercise of the granted right.
