RESOLUTION NO. 16-716
RESOLUTION APPROVING SALE AND CONVEYANCE OF PROPERTY AND
GRANTING OF EASEMENTS TO IOWA DEPARTMENT OF
TRANSPORTATION FOR INTERSTATE 35 LANE WIDENING AND
INTERCHANGE IMPROVEMENTS
FOR THE CITY OF AMES
WHEREAS, the Iowa Department of Transportation (IDOT) contacted the City in early 2015
regarding a project to replace an Interstate 35 (I-35) bridge that crosses over the South Skunk River,
which also includes the grading necessary to eventually allow for three lanes for both northbound and
southbound I-35 traffic just south of Ames; and,
WHEREAS, this project will require the IDOT to acquire 3.29 acres of City-owned land outright
and an additional 1.82 acres of permanent ingress/egress easement on the City's I-35 well field property;
and,
WHEREAS, in addition, the IDOT needs to acquire 0.12 acres of the Water Pollution Control
(WPC)Facility property for the purpose of the project; and,
WHEREAS, the City will be compensated a total of $58,200 for the I-35 well field land and
easements, plus $1,200 for the WPC Facility property; and,
WHEREAS,the purchase will be effective on December 31, 2016; and,
WHEREAS, pursuant to Iowa Code Section 364.7, notice was given on December 6, 2016, and
a public hearing is being held regarding the proposal of the City to sell and convey the property and grant
the easements; and,
WHEREAS,the sale and conveyance of the property is in the best interest of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
AMES, IOWA THAT:
1. Pursuant to Iowa Code Section 364.7, publication of notice regarding the sale and
conveyance of 3.29 acres of City-owned land outright and granting of easements for an additional 1.82
acres of permanent ingress/egress on the City's I-35 well field property and 0.12 acres of the Water
Pollution Control(WPC) Facility property, and establishing a public hearing date regarding the proposal
has been made.
2. The public hearing regarding the disposition of the property is hereby closed.
3. The said land is hereby conveyed:
proposed to sell and convey the following described real estate: (PARCEL 2) A parcel of land in the NWl/4
of the SE'/4 in Section 31, Township 83 North, Range 23 West of the 5t" Principal Meridian, Story County,
Iowa more particularly described as follows: Commencing at the S'/4 corner of said Section 31; thence
N00018'25"E, 1700.69 feet on the west line of the SE'/4 of said Section 31; thence S89041'35"E, 302.86
feet to a point on the existing easterly right of way line of Interstate Route Number 35; thence
N02016'45"W, 300.28 feet on said existing easterly right of way line; thence N00°12'08"E, 164.16 on
said existing easterly right of way line; thence S11°39'27"E, 102.18 feet; thence SO1027'38"W, 364.25
feet to the Point of Beginning, containing 0.12 acre. AND (PARCEL 8) A parcel of land partly in the
NW'/4 of the NE'/4 and partly in the SW'/4 of the NEl/4 all in Section 30, Township 83 North, Range 23
West of the 5" Principal Meridian, Story County, Iowa more particularly described as follows:
Commencing at the Center of said Section 30; thence N89°17'17"E, 102.65 feet on the south line of the
NE'/4 of said Section 30, to a point on the existing easterly right of way line of Interstate Route Number
35, the Point of Beginning; thence continuing N89017'17"E, 53.00 feet on said south line; thence
NO1°55'14"W, 2182.94 feet; thence N04°07'13"E, 364.12 feet to a point on the existing southerly right
of way line of 260t" Street; thence S85002'17"W, 81.16 feet on said existing southerly right of way line
to a point on the existing easterly right of way line of Interstate Route Number 35; thence SO1°23'44"E,
2257.38 feet on said existing easterly right of way line; thence SO4'O1'59"E, 282.52 feet on said existing
easterly right of way line to the Point of Beginning, containing 3.29 acres to the STATE OF IOWA; and
Grant an Easement for Ingress and Egress, for the following described real estate: A parcel of land partly
in the NW'/4 of the NE'/4 and partly in the SW'/4 of the NE'/4 all in Section 30, Township 83 North, Range
23 West of the 5th Principal Meridian, Story County, Iowa as shown on Acquisition Plat, Exhibit "A",
attached hereto, which by this reference is made a part hereof, more particularly described as follows:
Commencing at the Center of said Section 30; thence N 89°17'17"E, 155.66 feet on the south Tine of the
NE'/4 of said Section 30, to the Point of Beginning; thence continuing N 89°17'17"E, 25.00 feet on said
south line;thence N 0V55'14"W, 2183.24 feet;thence N05°02'46"E, 311.97 feet;thence N 77°45'5 F`E,
239.27 feet;thence N 8590'37'E, 370.54 feet;thence NO1°11'4F`E, 26.80 feet to a point on the existing
southerly right of way Tine of 260th Street; thence S 85°02'17"W, 376.12 feet on said existing southerly
right of way line; thence S 78°16'44"W, 263.10 feet; thence S 04°07'13"W, 332.76 feet; thence S
01055'14"E, 2182.94 feet to the Point of Beginning, containing 1.82 acres.; and,
to the STATE OF IOWA; Grant an Easement for Public Highway, for the following described real
estate: A parcel of land in the NW'/4 of the NE'/4 in Section 30, Township 83 North, Range 23 West of
the 5t" Principal Meridian, Story County, Iowa, more particularly described as follows: Commencing at
the N'/4 corner of said Section 30; thence N89°05'5I"E, 92.17 feet on the north line of the NW'/4 of the
NE'/4 of said Section 30; thence S00°54'09"E, 86.88 feet to a point on the existing southerly right of way
Tine of 260t" Street, the Point of Beginning; thence SO4°07'13"W, 31.36 feet; thence N78°16'44'T-,
263.10 feet to a point on said existing southerly right of way line; thence S85°02'17"W, 256.32 feet on
said existing southerly right of way line to the Point of Beginning, containing 0.09 acre.
