AGREEMENT BY SUBDIVIDER
TO PROVIDE PUBLIC IMPROVEMENTS
(Squaw Valley South Subdivision) i
WHEREAS, the proprietor of land to be subdivided is
required by virtue of sections 409.1 and 409 .7 of the Code of
Iowa to obtain the approval of the City Council of the City
in which 'such land is located or within two miles of such city
of a .plat of such proposed subdivision; and,
WHEREAS, Robert F. Carey (hereinafter called "developer")
proposes to subdivide and plat as the Squaw Valley South Subdivi-
sion, said plat having been filed with and considered by the
City Council, as provided. in Section 409. 7 , Code of Iowa; and,
WHEREAS, the City Council of the City of Ames is
empowered by Section 409 . 5 of the -Code of Iowa to " . . .require
the installation of sidewalks, paving, sewers, water, gas, and
electric utilities before the plat is approved" and has made
certain requirements with respect. thereto for the Squaw Valley
South Subdivision; and,
WHEREAS, the purpose. of this writing is to set out in
appropriate particularity the `required public improvements and
the developer® s agreement for installation, to-wit:
1. ' Sidewalks Installation. of' sidewalks is not
required.
2. ' Paving. All streets shall be at least a 22-foot
paved section. Paving must be completed within
three (3) years after the. filing of the plat with
the Story County Recorder. Paving work will be
inspected by the public works department of the
City of Ames, which will accept the. same standard
for such paving as is accepted by the Story County
Engineer. Failure of the Ames public works depart-
ment to inspect all or any portion of such paving,
however, shall not .bedeemed a waiver of the afore-
said requirement for street paving. Curbs and
gutters are not required. Street signs employed
will conform to those used in the City of Ames.
3. 'Sewer-s -- Sanitary. The developer shall build
an Extended Aeration Facility (EAF) on the lot
designated on the plat for that purpose in the
southwest corner of the subdivision. This facility
will be built and operated in accordance with the
standards, specifications and rules promulgated by
the Iowa Department of Environmental Quality. A
central collection system shall connect each lot
in the subdivision to the EAF, and no house shall
be occupied on a lot-until such connection to the
EAF is in place:. A11 sewer lines sha11 -be standard
eight inch. The sewer system shall be completed
within one year from the filing of the plat with
the Story County Recorder.
4.. Sewers Storm Water Drainage. An underground
storm water drainage system is not required.
5. Water. The developer shall establish a common
well or wells and a water distribution system to
each lot.. No house shall be occupied on a lot not
served by -such wells and water distribution system.

All water mains in the said water distribution
system shall be six-inch standard. Two fire
hydrants shall be installed by the developer
in the subdivision; one on the Matthews Road
west cul-de-sac and the other on Valley Road.
The water system shall be completed within
one year from the filing of the plat with the
Story County Recorder.
6 . Maintenance and Repair of Sewer, Water and
Street Systems. The City of Ames shall not be
responsible for the maintenance or repair of the
sewer, water or street systems of said subdivision,
and the same shall be repaired and maintained
under the terms and conditions of the restrictive
covenants executed .and filed in the above subdivi-
sion.
7. Annexation of Subdivision. It is further
agreed that at the time said subdivision is
annexed to the City of Ames, all sanitary sewer,
water and street facilities, except the extended
aeration facility and well supply system, shall
become the property of the City of Ames.
8. Construction of Sewer and Water Systems. The
construction of the sewer and water systems shall
be in compliance with. the appropriate specifica-
tions and agreements and certified by a licensed
professional engineer.
NOW, THEREFORE, the undersigned developer, having
submitted to. the Ames City Council a plat of subdivision of
land called the Squaw Valley South Subdivision, in consideration
of approval of said plat by the City Council, and in considera-
tion of other good and valuable considerations, the receipt of
which is hereby acknowledged, does hereby agree, warrant and
represent to the City of Ames, Iowa, that the aforesaid public
improvements will be made and installed in said subdivision as
set out above at the- sole expense of the undersigned developer.
