COUNCIL ACTION FORM
SUBJECT: ABANDONMENT OF UTILITY, OPEN DRAINAGE, AND STORM WATER
DETENTION EASEMENTS ACROSS PARTS OF LOTS 5, 6, 7, 8, & 9 EIGHTH
ADDITION SPRING VALLEY SUBDIVISION
BACKGROUND:
The Eighth Addition of Spring Valley Subdivision abuts Wyndham Heights Apartments.
Drainage from the apartment complex was allowed to be directed into the drainage and
detention easements that were on lots in the Eighth Addition of Spring Valley
Subdivision. Owners of these lots asked that this situation be reevaluated because of
the number of times the detention pond outlet had plugged.
Staff redesigned the drainage system so that the drainage and detention easements
could be eliminated. The owners of the apartment complex agreed to construct a small
detention pond on their property. The City agreed to pay for revised storm sewer
piping and the owners of the lots agreed to resod areas regraded and disturbed during
this process.
With this work completed the following open drainage and storm water detention
easements can be abandoned:
► The north 30 feet and east 30 feet of Lot 5
► The east 30 feet of Lot 6
► The east 30 feet and southeasterly 30 feet of Lot 7
► The southeasterly 30 feet of Lot 8 and Lot 9

The easterly 30 feet of these lots was also described as a utility easement. Telephone
and storm sewer are in the easterly 10 feet and will allow the westerly 20 feet of the
following utility easements to be abandoned.
► The east 30 feet of Lot 5 and Lot 6
► The east 30 feet and southeasterly 30 feet of Lot 7
► The southeasterly 30 feet of Lot 8 and Lot 9

MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council abandon the
westerly 20 feet of the 30 foot utility easement and abandon the 30 foot wide open
drainage and storm water detention easements that exist over Lots 5, 6, 7, 8, and 9
Eighth Addition Spring Valley Subdivision.
