Re: Conceptual Development Plan
Spring Valley Subdivision
Honorable 'Mayor and Members of City Council :
The Planning & Zoning Commission, during its regular meeting on May 3,
1978, considered the above Conceptual Development Plan and adopted the
following motion by a 6-0 vote (with Kahler absent):
That the Commission accept the staff recommendation to approve
the Conceptual Development Plan of Spring Valley Subdivision..
The developer proposes to submit at. a later time a PUD overlay for Lots A,
B, and C and Lots 75-92. The remainder of the project area will be developed
conventionally-with single-family houses.
The proposed. egress to the development between 'Lots 79 and 59 has been deemed
by staff to be an appropriate location irrespective -of Mr. Tsai 's request that
it be moved southerly to make connection. with his land (See correspondence from
Mr. Tsai ) . Staff takes the position that the proposed egress is central to all
undeveloped .lands to. the east and, therefore, affords greater flexibility in
design of future circulation patterns. Furthermore, if the egress were moved to
the south to connect with Mr. Tsars land, he could only create a stub develop-
ment (off,,Sprinq Valley), on the larger most westerly portion of his land and,
therefore, not be able to fully extend the street. to Delaware unless it would be
done through cooperation with the landowner to. the north_. Moving the egress to
the south would also adversely effect the CDP's concept of using the egress as a
separation between single-family detached homes to the south (starting with Lot
59) and PUD .development to the north (starting with Lot 79) .

Gentlemen: =
We are the owners of the 5.1-acre property bordering the
southeast corner of the proposed Spring Valley Subdivision for
738 feet. We have investigated the conceptual development plan
of the subdivision and believe that the plan presents a blockage _
to the future development of the property because it does not
provide any access- to the property,, -_ _ -
Although there is a dedicated future access-` on the'-east -
side of the subdivision, which is provided presumably for the
future development of the eastern adjacent properties.-, the access
is not accessible to our property which is= one of -the two adjacent
properties on the east side of the subdivision,-
We respectfully request that the future access on the plan
be relocated, moving southward for about 125 feet to a location
accessible to our property.

FINDINGS:
Land Use Policy Plan
The Land Use Policy Plan designates a portion of this area as being suitable
for low density residential; development. The remainder of the area, .outside the
Urban Service Area, is designated as suitable for residential expansion..

Transportation
Access ,to the site will be provided via Ontario Road which will be paved in the
near future. Access to the interior of the site is provided by one road from-
Ontario. That will serve as the only access to the site until the access provided
to the east is constructed. This raises a question of safety with regard to the
present limited access.' . Certain portions of the.vehicular movement system become
-critical and an accident at any critical point could theoretically prevent the
passage of emergency vehicles to other portions of'°=the development.,
Physical Characteristics
Vegetation -- The area is characterized by extensive amounts of vegetation along
the fence rows and Clear Creek.
Terrain Most of the site is generally flat except for the -area along Clear
Creek and a natural drainageway which flows across the site to
Clear Creek.
Drainage -- Drainage is,' generally to the south and west.
Soils --
Flooding - Portions of the site along Clear Creek may be susceptible to
flooding but those areas will become' dedicated greenways.
ANALYSIS:
1. The CDP reflects a ,sensitive approach to development of.this area. Although
the plan takes advantage of the natural features� of the site, it does so in
such a way that those natural features are preserved.
2. As noted on the plan, Lots A, B, & C are intended for development of multiple-
fai�ily & townhouse.-development. A PUD for those lots plus single-family lots.
75-92 will be submitted at a later date.
3. Some consideration should be given to the possibility of providing another
access to the site from Ontario Road.
4. Because of the property characteristics to the east, it may be advantageous
to move the access ''road. further south so the centerline lines- up with the
property lines adjacent to the east. The designer has agreed to look at that
possibility. .
RECOMMENDATION:
The Department of Community Development recommends,'Ithat this .Conceptual
Development Plan be approved.
