Lot A - Spring Valley Subdivision First Addition BACKGROUND Attached -is a letter fran the Spring Valley Subdivision developer's attorney requesting Council acceptance of.a deed for Lot A of the First Addition of the Spring Valley Subdivision. As explained in the attached letter, Lot A was dedicated to the City on October 9, 1979. However, the City Council has never formally accepted a deed for Lot A. Lot A is a 20-foot wide strip between Lots 14 and 15 as indicated on the attached plat map. Lot- A is intended to serve as a public access point to a greenbelt area of approximately 6 acres which is proposed to be dedicated to the City as part of the eventual development of the Spring Valley Subdivi- sion Second Addition. The. greenbelt area was identified on the Conceptual Development Plan which was approved by the City Council for the Spring Valley Subdivision. However, a final plat has not yet been created for the Second Addition. . The greenbelt area would border Clear Creek and would be directly �J west of Lot A. Conversations have occurred between City staff and the Spring Valley Subdivi- sion developers regarding the -developer's intention to create -a suitable accessway .on Lot A to the greenbelt area in the Spring'Valley Second Addition at the time of its development. Currently Lot A consists of shrubs and various other low-lying vegetation which would have to be cleared in order to create a suitable accessway. The developer has agreed to provide a suitable accessway on Lot A at the time in which the Second Addition is developed. As such, staff will include the development of Lot A as a suitable accessway to the greenbelt area as .a condition of the approval of the final plat of the Spring Valley Subdivision Second Addition at the appropriate time. ALTERNATIVES:' 1. Approve a resolution accepting a deed for Lot A of the Spring Valley Sub- division First Addition. 2. Reject the deed for Loth A of the Spring Valley Subdivision. It should be noted that Lot A was dedicated to the City on October 9, 1979, and that a City sanitary sewer main exists on Lot A. MANAGERS RECOMMENDED ACTION. It is recamTended by the City Manager that the City Council adopt Alternative, #1 approving a resolution accepting a deed for Lot A of the Spring Valley Subdivision First Addition. It is understood that the Council's acceptance of a deed for Lot Ain no waybinds the City to y perform any irrprovements or regular maintenance of the lot. The lot currently consists of low lying vegetation and shrubs which do not require regular- maintenance. A stipulation of the City's. acceptance of Lot A is that the developer of the Spring Valley Subdivision Second Addition will be responsible for developing Lot A in the future. If the City Council chooses to accept the 6-acre green- belt when the Spring Valley Second Addition is platted, the City will specify that .the developer develop Lot A into a suitable accessway as a stipulation for approval of the Final Plat of the Second Addition. Lot A, Spring Valley Subdivision. A copy of a letter from the subdivider's attorney and the plat of the subdivision are attached for your information. Lot A is a twenty foot wide strip between Lots 14 and 15. The real estate is legally described as follows: Lot A, First Addition, Spring Valley Subdivision to Ames,.Iowa; Lot A was dedicated to the City on October 9, 1979, at the time of the dedication of Spring Valley Subdivision. I enclose a copy of the dedication. I also enclose a copy of the plat diagram showing Lot A. I think the evidence is clear that the developers and the City intended for the City to own Lot A from and after the date the subdivision was approved. I agree with you that the enclosed deed will further codify this intention. The developers learned of the problem when they got notice that Lot A was subject to the real estate tax assessment. Thinking it appropriate to resolve the .problem, they filed a petition with the Board of Review. However, instead of the Board of Review placing a zero valuation on the property, they placed a value of $500.00 on the property. It seems to me that when the City Council understands the problem and authorizes you to record the enclosed deed, they could authorize you to talk with Richard Horn to get the records amended to reflect that the property was City property as of January 1, 1984. When the land in Spring Valley abutting the proposed green belt area is subdivided, the developers agree to improve Lot "A". as a public access.
