RESOLUTION NO. 16-513
RESOLUTION APPROVING VACATION OF WATER MAIN EASEMENT FOR
1010 DICKINSON AVENUE
FOR THE CITY OF AMES,IOWA
WHEREAS, when the basketball facility at 1010 Dickinson Avenue was originally brought
before City staff, it was noted that the existing water main would be in conflict with the building
footprint; and,
WHEREAS, the developer then relocated the water main as to not be within the building
footprint during construction of the facility; and,
WHEREAS,the property owner is now in the process of final platting the lot to parcel off the
east portion of the lot for the new Iowa State University tennis practice facility, and as part of this
process,the existing easement will be vacated and a new easement will be created to reflect the actual
water main installation location with the final platting of the lots; and,
WHEREAS, approval of the new easement will be brought to the City Council as part of the
final plat for the facility, and this action is intended to coordinate the vacation of the existing easement
with the creation of the new easement; and,
WHEREAS,the existing easement vacation will be recorded in conjunction with the new final
plat of the parcels in order to protect the City's interest with regards to the water main that is currently
within the easement area; and,
WHEREAS,pursuant to Iowa Code Section 364.7,notice was given on September 1,2016,and
a public hearing is being held regarding the proposal of the City to vacate the easement; and,
WHEREAS, vacation of the easement is in the best interest of the City.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
AMES, IOWA THAT:
1. Pursuant to Iowa Code Section 364.7, publication of notice regarding the proposed
vacation of the public utility easement and establishing a public hearing date regarding the proposal has
been made.
2. The public hearing regarding the disposition of the property is hereby closed.
3. The existing public utility easement across the following described land is hereby
vacated:
A PART OF LOT 2, 6TH ADDITION,DAUNTLESS SUBDIVISION,AN OFFICIAL
PLAT IN THE CITY OF AMES, STORY COUNTY, IOWA AND MORE
PARTICULARLY DESCRIBED AS FOLLOWS:THE NORTH 15.00 FEET OF SAID
LOT 2 CONTAINING 0.09 ACRES (4,098 SQUARE FEET).
ADOPTED THIS 13`h day of September, 2016.
