SUBJECT: Subdivisiion--Southern Hills 2d Addition
REFERENCE: Repeal of Approval, Revocation of Permits
The final plat of subdivision for Southern Hills 2d Addition was
approved by the City Council in May. As of this date the platting
documents have not been filed with the County Recorder. On January 4,
in response to a request for assistance from the City Clerk, I spoke by
phone with the subdividers attorney and was assured that he would be
filing the documents in the following week.
The City has in its posession duplicate originals of all documents
needed to file the plat except for the sec. 354.112 (5) ". . .certificate
of the treasurer that the land is free from certified taxes and
certified special assessments. . . ". The treasurers office has informed
the Clerk that a payment of more thn $30,000. 00 will be necessary to
obtain the issuance of the required treasurers certificate.
I called the attorney today and was informed that he was out of the
office until Thursday. It is my advise that no building permits be
issued with respect to purported lots in the Southern Hills 2d Add.
because legally the land is not officially platted. It is appropriate
at this time to report this matter to the City Council with the
recommendation that:
a)the resolution approving the plat be repealed
-- - - b)any building-permits thatha--ve-been-iss-ued -be--revocked. -Of course, notice and an opportunity to be heard should be provided to
the subdivider before the Council takes action to cancel the
suvdivision and revock the permits.
