RESOLUTION APPROVING RETAINER AGREEMENT WITH LAW FIRM FOR
OUTSIDE COUNSEL SERVICES FOR LEGAL DEPARTMENT
FOR THE CITY OF AMES
WHEREAS, at the last Council meeting, the Legal Department received approval to move
forward with a proposal to retain additional outside counsel in light of the fact that the original
attorney who was performing the City's prosecutions is out on maternity leave; and,
WHEREAS, additionally, the process to fill the vacant attorney position in the Legal
Department is moving forward very slowly; and,
WHEREAS, because these circumstances will continue into the foreseeable future, this
agreement has been written to allow use of all of Hopkins and Huebner's services on an"as needed"
basis; and,
WHEREAS, due to the short deadlines that are often faced in the Legal Department and
considering the time-consuming nature of several projects that are coming soon,the City may find
it beneficial to keep the option open to engage this law firm for other select projects when needed;
and,
WHEREAS, a retainer arrangement has been reached with the Hopkins and Huebner Law
Firm of Des Moines, Iowa, for this purpose; and,
WHEREAS, the City has had very good experiences with this firm when it has served as
outside counsel in the past; and,
WHEREAS,the Hopkins and Huebner Law Firm is a large enough company that specializes
in many areas and has the ability to take on additional work from the City on short notice,should the
need arise.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,
that the Retainer Agreement with the Hopkins and Huebner Law Firm of Des Moines, Iowa, for
outside counsel services, in an amount up to $50,000, is hereby approved.
