RESOLUTION NO. 16-427
RESOLUTION SETTING DATE OF PUBLIC HEARING FOR
VACATION OF PUBLIC ACCESS EASEMENT
AT 720 SOUTH DUFF AVENUE
FOR THE CITY OF AMES,IOWA
WHEREAS,the Council approved a Final Plat for U-Haul Subdivision, First Addition, at its
meeting on May 10,2016,and that plat also included the grant of an Access Easement to provide access
from the rear of South Duff Avenue properties to the planned traffic signal in front of Wal-Mart; and,
WHEREAS,the easement is intended to augment access to those properties after the median
and traffic light are installed; and,
WHEREAS, as the Public Works Department moves forward with design for the project, the
easement provided by U-Haul needs to be replaced with language that more explicitly grants access to
the public, and U-Haul has agreed to provide for an updated easement that meets the interests of the
City; and,
WHEREAS,it is requested that the Council set August 9,2016,as the date of the public hearing
to consider vacation of the easement,and at that same meeting,the City Council will be asked to accept
a new easement; and,
WHEREAS,pursuant to Iowa Code section 364.7, it is necessary to provide notice and public
hearing regarding the proposal of the City to dispose of its interest in this real property; and,
WHEREAS, following notice and public hearing, the City will determine if this proposal is
appropriate.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
AMES, IOWA, THAT:
1. Pursuant to Iowa Code section 364.7, publication of notice regarding the proposed
vacation of an public access easement and establishing a public hearing date regarding
the proposal is required.
2. The public hearing regarding the proposal to consider vacation of the City's interest in
a public access easement at 720 South Duff Avenue shall be held on August 9,2016, at
6:00 p.m.
3. The City Clerk is hereby directed to provide notice of the public hearing as required by
Iowa Code section 362.3.
