COUNCIL ACTION FORM
SUBJECT: RESOLUTION APPROVING THE FINAL PLAT OF THE SOUTH DUFF
COMMUNITY PARK SUBDIVISION.
ACTION FORM SUMMARY: The applicant is requesting the approval of the Final Plat for
the South Duff Community Park subdivision, located east of South Duff Avenue near the
former waste water treatment plant of the City of Ames. Staff has reviewed the Final Plat
documents and has determined that all requirements have been met.
Staff recommends that the Final Plat of the South Duff Community Park subdivision be
approved.
BACKGROUND: On August 24, 1999, the City Council approved the preliminary plat for
the South Duff Community Park subdivision. The proposed subdivision includes the
creation of 5 lots. Access to the lots will be provided by the existing right-of-way of the City
that is referred to as Billy Sunday Road and proposed right-of-way that is land owned by
the City that will be declared right-of-way as part of the approval of this plat.
On July 13, 1999, the City Council approved a resolution that would declare the land that
is owned by the City as public right-of-way at the time that the Council takes action on the
Final Plat. The declaration of public right-of-way is necessary to fulfill the requirement that
all lots in a subdivision have access and front on a public right-of-way.
ANALYSIS;
The proposed lots range in size from 2.3 to 6.3 acres. The property in question is zoned
G-C General Commercial. Infrastructure that is needed to provide service to the proposed
lots is already existing or is planned to be installed. The infrastructure that is yet to be
installed includes street improvements, storm sewer improvements, some sanitary sewer
and water infrastructure, bike path improvements, and street lights.
The infrastructure that is yet to be installed will be financed by a special assessment that
will be repaid by the property owner. An agreement that documents the responsibilities
relative to the special assessment program is attached to this action form. In addition this
agreement includes the standard waiver of rights provisions that assures that the special
assessment taxes will be paid.
Staff has reviewed this final plat and has determined the final plat of the South Duff
Community Park subdivision meets the requirements of the City.
ALTERNATIVES:
1. The City Council can approve the Final Plat of the South Duff Community Park
subdivision.
2. The City Council can deny the Final Plat of the South Duff Community Park subdivision.
3. The City Council can refer this request back to staff for additional information.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt Alternative #1.
This action will approve the Final Plat of the South Duff Community Park subdivision,
including the agreement for the installation of the required public improvements that are
to be installed through a special assessment program financed by the City and repaid by
the property owner.
