WATER MAIN EASEMENT
THIS AGREEMENT is made beczy4w2l ,1999, DICKSON D.
JENSEN and LUANN C. JENSEN (Jensens), whose address is 235 Alexander,
Ames, IA 50010, hereby grant to the City of Ames, Iowa, the perpetual
right to the following described easement.
1. OWNERSHIP OF REAL ESTATE. Jensens are the owners of real estate
located in Story County, and described as:
Lot 5, South Duff Community Park, Ames, Iowa
2. CONVEYANCE AND DESCRIPTION OF WATER MAIN EASEMENT.
Jensens hereby convey to the City of Ames, Iowa, a 10.00 foot wide
easement for water main purposes under and across the following
described parcels:
a. The East 10.00 feet of the West 25.00 feet of the North 95.00
feet of Lot 5;
b. The South 10.00 feet of the North 95.00 feet of the East 227.00
feet of the West 242.00 feet of Lot 5; and
C. The East 10.00 feet of the West 242.00 feet of the South 140.00
feet of the North 225.00 feet of Lot 5
all within SOUTH DUFF COMMUNITY PARK, AMES, IOWA, according to the
following terms and conditions.
-3. MAINTENANCE. The City shall install- and maintain its water main
lines, consisting of all underground water main lines, connections, hook-
ups and similar equipment or any part thereof, for the sole purpose of
general water main use, together with the right to go upon the easement
area, make repairs, install lines, connect to existing lines and to extend the
said lines or mains to any other property or location within the said
easement area described above for the safe operation of sanitary sewer
and water main lines underground or adjacent to South Duff Community
Park,
4. ACCESS. The City of Ames shall have the right of access to the
easement areas granted in this Easement Grant together with rights of
ingress and egress reasonably necessary for the use and enjoyment of the
easement area for the purposes described, including, but not limited to:
r 1 . the right to remove any unauthorized obstructions or
structures placed or erected on the easement area and the right, and
2. the right to improve, repair and maintain the easement area,
5. CONDITION. The foregoing rights are granted upon the express
condition that the users of the granted rights will assume liability for all
damage to the hereinbefore described real estate and adjoining real
estate caused by failure to use due care in the exercise of the granted
rights
