WHEREAS , Russell S . Soper and Helen D . Soper , husband
and wife , are the owners and developers of certain real estate
known as Soper ' s Meadow Subdivision of Ames , Iowa , and
WHEREAS , for their own protection and for the benefit
of subsequent owners of the lots within the said
subdivision , said owners desire to restrict the use thereof
in certain particulars thereby protecting the value and
desirability of said subdivision .
NOW , THEREFORE , the owners hereby declare that all the
property described above , namely Soper ' s Meadow Subdivision
of Ames , Iowa , shall be held , sold and conveyed subject to the
following restrictions , covenants and conditions , which shall
run with the property and be binding on all parties having any
right , title or interest in the property or any part thereof ,
their heirs , successors and/or assigns , and shall inure to the
benefit of each owner thereof , as follows :
1- That all lots shall be known and described as
residential lots and shall not be improved , used , or
occupied for other than private single-family residential
purposes.
z- That no lot shall be subdivided into additional
building lots , but any lot may be divided to enlarge an
existing lot.
3- That Helen D . Soper and Russell S . Soper , as owners
and developers of Soper ' s Meadow Subdivision of Ames , Iowa
or their successors in interest , shall approve all plans
prior to construction in reference to architectural
character , design , and type of construction and a full set
of plans will be provided to Helen D . Soper and Russell S.
Soper , or their sucessors in interest . If the owners and
developers sell a lot to a person who in turn sells the lot
to another person before building thereon , the next owner in
turn must obtain plan approval from the owners and developers
as provided hereto . Aforesaid architectural approval shall
include all initial external house and masonry colors .

4- That the minimum finished floor area requirements are
as follows :
a) One story dwellings
Ground floor - 1200 square feet
b) One and one half story dwellings
Ground floor - 800 square feet
Total area - 1400 square feet
c) Two story dwellings
Ground floor - 800 square feet
Total area - 1600 square feet
d) Split-level dwellings
Ground floor - 800 square feet
Total area - 1400 square feet .
e) In the computation of floor areas , the porches ,
breezeways , or attached or built in garages
shall not be included.
5- Each house shall have at least a two car garage and
all driveways shall be of concrete .
6- All exterior construction must be completed within
twleve months after commencing excavation for the basement
or footings.
7- That no trailer , basement , tent , shack , garage , barn ,
or other outbuildings erected on said lots shall at any time
be used as a residence either temporarily or permanently , nor
shall residences of a temporary nature be permitted .
8- That the side five (5) feet of each lot in the
subdivision shall be subject to surface drainage easements .
Utility easements are shown on the Final Plat of the
subdivision.
9- That no obnoxious or offensive trade shall be
carried on upon any lot , nor shall anything be done thereon
which may be or may become a nuisance to the neighborhood .
10- That no mobile home as defined in the Code of Iowa
shall be placed on or erected on any lot .
11- That no exterior towers , antennas , or satellite
dishes of any kind shall be constructed , modified , or
permitted on the ground of any building lot . Reasonable
television or radio antennas are permitted on dwellings or
garages .
12- That following the construction of the residential
dwelling on any lot the front yard and the side yard shall
be seeded or sodded . The rear yard may be sodded ,seeded , or
planted with erosion control planting.
13- That the front sidewalk shall be constructed within
one year after the sale of any lot or at the time of the
occupancy of any dwelling on a lot , whichever occurs first .

14- That all of these restrictions shall be deemed to
be covenants running with the land and shall endure and be
binding upon the parties hereto , their successors and
assigns , for a period of twenty-one years from the date of
the recording of these covenants , unless .claims to continue
any interest in the covenants are filed as provided by law .
15- That in case of violation of any of the covenants ,
any person then owning a lot in said subdivision or the City
of Ames , Iowa , is authorized to resort to an action of law
or equity for relief , either by injunction or in damages ,
against the person so violating said covenant , after first
discussing the alleged violation with the lot owner .
1E - That these covenents may be amended by a vote of
eight (3) of the twelve ( 12) Lot owners , each Lot having
one vote and cast by the Lot owner (s) . Any amendment must be
recorded in the Office of the Story County Recorder to
become effective .
17- That invalidation of any of these covenants by
judgement or court order shall in no way effect any of the
other provisions , but shall remain in full force and effect .
IN WITNESS WHEREOF , Russell S . Soper and Helen D. Soper
haves ca sed this instrument to be executed this �� day

appeared Russell S. Soper and Helen D . Soper , husband and
wife , personally known to me to be the identical persons
named in and who executed the foregoing instrument and

act and deed.
