RESOLUTION NO. 16-313
RESOLUTION SETTING DATE OF PUBLIC HEARING FOR
GRANTING OF AN ACCESS EASEMENT ACROSS CITY PROPERTY
(WELCH PARKING LOT X) FOR THE BENEFIT OF THE
REDEVELOPMENT AT 122 HAYWARD AVENUE
FOR THE CITY OF AMES,IOWA
WHEREAS, the owner of two properties proposes to merge these parcels for redevelopment at
122 Hayward Avenue into a new mixed-use student housing; and,
WHEREAS,the developer has requested that the Council grant a perpetual access easement for the
benefit of the development at 122 Hayward Avenue through the City's parking area to the west of Welch
Avenue; and,
WHEREAS,the City Council first reviewed this request on April 26, 2016, and gave direction to
the City Attorney to draft an easement granting access rights across City property; however, the easement
language was to be as general as possible about providing for access,but not in manner that delineates a
precise route for access so as to not limit future use of the property by the City; and,
WHEREAS, under state law, when a City grants the use of public property for a term exceeding
three years, it requires a public hearing on the matter prior to approval of an agreement for the use of City
property; and,
WHEREAS, following notice and public hearing, the City will determine if this proposal is
appropriate.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
AMES, IOWA, THAT:
1. Pursuant to Iowa Code section 364.7, publication of notice regarding the proposed access
easement and establishing a public hearing date regarding the proposal is required.
2. The public hearing regarding the proposal to consider granting of the City's interest in an
access easement for 122 Hayward Avenue through the City's Parking Lot X(Welch Avenue
Parking Lot) shall be held on May 31, 2016, at 6:00 p.m.
3. The City Clerk is hereby directed to provide notice of the public hearing as required by Iowa
Code section 362.3.
